The High Court of Cassation and Justice (Administrative and Fiscal Litigation Section) granted the revision request filed by the Commission for the Certification of Anti-Communist Resistance Fighters (M.J.), partially changing its prior Decision No. 525 of 30 January 2007. The court corrected the earlier ruling to order the Commission to grant the status of anti-communist resistance fighter to the claimant’s mother, E.C., while maintaining all other provisions of the prior decision. The dispute arose from a claim by C.M.L. seeking that status for her mother, based on forced relocation and political persecution from 1949–1962; the initial decision had erroneously awarded the status to the maternal grandparents (C.I. and C.E.) instead of the mother, despite the request only covering the mother and despite the grandparents already having received such status through separate rulings. The legal basis was Article 322(1)(2) of the Code of Civil Procedure (revision for granting more than was requested, *ultra petita*), applied consistently with the substantive requirements of Article 3(c) and (d) of Government Emergency Ordinance No. 214/1999 on the certification of anti-communist resistance fighters.

Asupra cererii de revizuire de față;
