Uredba o ratifikaciji Memoranduma o soglasju med Vlado Republike Slovenije in Vlado Republike Hrvaške

Ratificira se Memorandum o soglasju med Vlado Republike Slovenije in Vlado Republike Hrvaške, podpisan v Mokricah dne 11. marca 2013.

Memorandum of Understanding between the Government of the Republic of Slovenia and the Government of the Republic of Croatia

The Government of the Republic of Slovenia and the Government of the Republic of Croatia agree that the settlement for the transferred foreign currency savings of the Ljubljanska banka in Croatia will be found on the basis of the Agreement on Succession Issues (Annex C).

The Government of the Republic of Slovenia and the Government of the Republic of Croatia are determined to find a comprehensive solution for this issue as soon as possible. To this end, they will actively proceed with the continuation of negotiations under the auspices of the BIS in line with the Agreement on Succession Issues.

Pursuant to this MOU, and pending the resolution of this issue pursuant to paragraph 2 of this MOU, the Government of the Republic of Croatia will ensure the stay of all judicial proceedings initiated by two Croatian banks (ZaBa and PBZ) related to the transferred foreign currency savings. The Government of the Republic of Slovenia will ensure that LJB as the defendant in these proceedings agree to stay as well.

In addition, the Government of the Republic of Croatia shall ensure that with a view to resolving the above issue, no new judicial or other proceedings are initiated with regard to the issue defined in the first paragraph of this MOU.

The Government of the Republic of Slovenia undertakes to immediately initiate in the National Assembly the procedure for the ratification of the Treaty on the Accession of the Republic of Croatia to the EU with a view to complete the ratification process as soon as possible after the signature of this MOU.

This MOU shall enter into force on the day of receipt of the last notification through the diplomatic channels by which the Parties notify each other of the fulfilment of their respective internal procedures.

Memorandum o soglasju

Vlada Republike Slovenije in Vlada Republike Hrvaške soglašata, da se rešitev za prenesene devizne vloge Ljubljanske banke na Hrvaškem najde na podlagi Sporazuma o vprašanjih nasledstva (Priloga C).

Vlada Republike Slovenije in Vlada Republike Hrvaške sta odločeni, da bosta celovito rešitev za to vprašanje našli čim prej. V ta namen bosta dejavno pristopili k nadaljevanju pogajanj pod okriljem BIS skladno s Sporazumom o vprašanjih nasledstva.

Vlada Republike Hrvaške na podlagi tega memoranduma o soglasju do končne rešitve tega vprašanja skladno z drugim odstavkom zagotovi ustavitev vseh sodnih postopkov, ki sta jih začeli dve hrvaški banki (ZaBa in PBZ) v zvezi s prenesenimi deviznimi vlogami. Vlada Republike Slovenije zagotovi, da bo LJB kot tožena stranka v teh postopkih soglašala z ustavitvijo.

Poleg tega Vlada Republike Hrvaške zagotovi, da se z namenom reševanja navedenega vprašanja ne bodo začeli novi sodni ali drugi postopki v zvezi z vprašanjem iz prvega odstavka tega memoranduma.

Vlada Republike Slovenije se zavezuje, da bo v Državnem zboru nemudoma začela postopek za ratifikacijo Pogodbe o pristopu Republike Hrvaške k Evropski uniji, da bi se ratifikacijski postopek dokončal čim prej po podpisu tega memoranduma.

Ta memorandum začne veljati z dnem prejetja zadnjega od uradnih obvestil, s katerima se pogodbenici po diplomatski poti obvestita o dokončanju notranjepravnih postopkov.

Podpisano v Mokricah dne 11. marca 2013 v dveh izvirnikih v angleškem jeziku.

3. člen

Za izvajanje memoranduma skrbita ministrstvo, pristojno za finance, in ministrstvo, pristojno za zunanje zadeve, v sodelovanju z visokim predstavnikom Republike Slovenije za nasledstvo.

4. člen

Ta uredba začne veljati naslednji dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
