COOPERATION PROGRAMME

between the Minister of Culture of the Republic of

Poland and the Ministry of Culture of the Government of the Republic of India for the years 2005—07

Minister Kultury Rzeczypospolitej Polskiej oraz Ministerstwo Kultury Rzàdu Republiki Indii, zwani dalej

„Stronami”,

The Minister of Culture of the Republic of Poland

and the Ministry of Culture of the Republic of India,

hereinunder referred to as the Parties,

dà˝àc do pog∏´bienia wspó∏pracy w dziedzinie kultury mi´dzy obu krajami,

striving to intensify the cooperation in the field of

culture between both countries,

majàc na uwadze postanowienia Umowy o wspó∏pracy kulturalnej mi´dzy Polskà Rzeczàpospolità Ludowà a Republikà Indii, podpisanej w New Delhi dnia

27 marca 1957 r.,

considering the provisions of the Agreement on

cultural cooperation between the Polish People’s Republic and the Republic of India, signed in New Delhi

on 27th of March 1957,

Article 1

Strony b´dà sprzyja∏y bezpoÊredniej wspó∏pracy

1) Muzeum Narodowego w Warszawie z Muzeum

Narodowym Indii oraz Narodowà Galerià Sztuki

Nowoczesnej Jaipur House w New Delhi;

2) Muzeum Azji i Pacyfiku w Warszawie z Muzeum

Salar Jung w Hyderabadzie.

Both Parties will encourage direct cooperation between

1) The National Museum in Warsaw with the National Museum of India and the National Gallery of

Modern Art, Jaipur House in New Delhi;

2) The Museum of Asia and Pacific in Warsaw with

the Museum Salar Jung in Hyderabad.

Wspó∏praca b´dzie obejmowa∏a wizyty specjalistów, a tak˝e wymian´ publikacji i informacji.

The cooperation will comprise visits of specialists, as

well as the exchange of publications and information.

Article 2

Strony b´dà popiera∏y wspó∏prac´ w dziedzinie archiwistyki. Wspó∏praca b´dzie obejmowa∏a wymian´

archiwistów (czternastodniowe pobyty), a tak˝e wymian´ wystaw, publikacji i informacji. Strony b´dà

u∏atwia∏y wymian´ fotokopii i mikrofilmów zbiorów

stanowiàcych przedmiot ich zainteresowania, na zasadzie wzajemnoÊci i zgodnie z obowiàzujàcymi w obu

krajach przepisami.

Both Parties will support cooperation in the field of

keeping archives. The cooperation will include the

exchange of archivists (fourteen day visits), as well as

the exchange of exhibitions, publications and information. The Parties will facilitate the exchange of photocopies and microfilms of collections they are interested in on mutual terms and in compliance with the

laws in force in both countries.

Article 3

Strony b´dà popiera∏y realizacj´ wizyt studyjnych

i warsztatów prowadzonych przez re˝yserów teatralnych, wyk∏adowców szkó∏ teatralnych lub scenografów. Wizyty b´dà trwa∏y od 2 do 4 tygodni.

Both Parties will support the realization of study visits and workshops led by theatre directors, lecturers

of theatre schools or stage designers. The visits will

last from 2 to 4 weeks.

Strony wymienià po jednej osobie na 2—3-tygodniowy pobyt sta˝owy w nast´pujàcych dziedzinach

The Parties will exchange one person each for

2—3 weeks training stay in the following fields

1) dziedzictwo kultury;

1) cultural heritage;

2) muzealnictwo;

2) museums;

3) projektowanie ubiorów (wzornictwo i technologie).

3) designing of clothes (model-making and technologies).

Przedstawiciele Strony polskiej na zaproszenie

Strony indyjskiej wezmà udzia∏ w wystawie Triennale-India. Eksponatom mogà towarzyszyç komisarz lub

kurator wraz z dwoma bioràcymi udzia∏ w wystawie

artystami. Komisarz b´dzie móg∏ wziàç udzia∏ w Seminarium Mi´dzynarodowym, a uczestniczàcy artyÊci —

w Mi´dzynarodowych Warsztatach zorganizowanych

równolegle z Triennale. Strona polska zaprosi przedstawicieli Strony indyjskiej do udzia∏u w biennale lub

triennale zorganizowanym w Rzeczypospolitej Polskiej, na zasadzie wzajemnoÊci.

Representatives of the Polish Party, on invitation

of the Indian Party, will participate in the Triennale-India exhibition. Exhibits may be accompanied by

a commissioner or curator together with two artists

taking part in the exhibition. The commissioner may

participate in the International Seminar, and the participating artists in the International Workshops organized in parallel with the Triennale. The Polish Party will

invite representatives of the Indian Party to participate in a biennial or triennial organized in the Republic

of Poland on the basis of reciprocity.

czyni∏y starania, aby doprowadziç do wymiany wystaw artystycznych.

During the term of this Programme, the Parties will

strive to put into effect the exchange of artistic exhibitions.

Artyku∏ 7

Article 7

Strony b´dà popiera∏y wspó∏prac´ w zakresie

ochrony, konserwacji i poznania dziedzictwa kultury

obydwu krajów. W czasie obowiàzywania programu

Strony wymienià po jednym ekspercie z dziedziny

ochrony i konserwacji zabytków na okres dwóch tygodni.

Both Parties will support cooperation in the field of

protection, conservation and promotion of the cultural

heritage of both countries. During the term of this Programme, the Parties will exchange one expert each in

the field of protection and conservation of antiquities

for a two-week period.

Article 8

Biblioteka Narodowa w Kalkucie dokona wymiany

materia∏ów wybranych zgodnie z zainteresowaniem

Stron, w tym mikrofilmów i mikrofisz, z bibliotekami

lub innymi w∏aÊciwymi instytucjami w Rzeczypospolitej Polskiej.

The National Library in Kolkata will exchange materials selected according to the interest of the Parties,

including microfilms and diamicrocards, with libraries

or other appropriate institutions in the Republic of Poland.

Article 9

Strony b´dà popiera∏y dokonywanie przek∏adów

swoich dzie∏ literackich z j´zyka polskiego na jeden

z j´zyków indyjskich i odwrotnie.

Both Parties will support the translation of their literary works from the Polish language into one of the

Indian languages and vice versa.

Article 10

Strony b´dà dà˝y∏y do wymiany zespo∏ów tanecznych, muzycznych oraz folklorystycznych.

Both Parties will strive to exchange dance, music

and folklore groups.

Artyku∏ 11

Article 11

Strony b´dà popieraç wymian´ filmów na zasadach handlowych i niekomercyjnych, przeprowadzenie wzajemnych przeglàdów filmowych, udzia∏ filmów

w mi´dzynarodowych festiwalach organizowanych

w kraju drugiej Strony, zgodnie z regulaminami tych

festiwali, oraz bezpoÊrednià wspó∏prac´ w dziedzinie

kinematografii mi´dzy organizacjami skupiajàcymi

twórców, producentów i dystrybutorów, a tak˝e archiwami filmowymi i innymi w∏aÊciwymi jednostkami

i organizacjami z obu paƒstw.

Both Parties will support exchange of films on

commercial and non-commercial principles, carrying

out mutual film reviews, participation of films in the

international festivals organized in the country of the

other Party in conformity with the rules and regulations of these festivals, and direct cooperation in the

field of cinematography between organizations of creators, producers and distributors, as well as film archives and other appropriate entities and organizations

of both countries.

Strony rozwa˝à mo˝liwoÊç realizacji nowych projektów w dziedzinach obj´tych programem.

In case additional propositions are received the

Parties will consider the possibility to realize new projects in the areas covered by this Programme.

Article 13

Strona wysy∏ajàca przeka˝e Stronie przyjmujàcej

co najmniej na trzy miesiàce przed proponowanym

terminem wizyty wszelkie niezb´dne dane dotyczàce

osób, których dotyczy wymiana obj´ta programem,

w szczególnoÊci: imi´ i nazwisko, dat´ urodzenia, zawód, znajomoÊç j´zyków obcych, proponowany program pobytu oraz przybli˝ony termin przyjazdu. Po

uzyskaniu zgody na realizacj´ wizyty Strona wysy∏ajàca powiadomi z co najmniej dwutygodniowym wyprzedzeniem Stron´ przyjmujàcà o dok∏adnym terminie przyjazdu i Êrodku transportu.

The Sending Party will transmit to the Receiving

Party, at least three months before the proposed visit

date, all necessary data regarding the persons involved in the exchange covered by this Programme, and

in particular first name, surname, date of birth, profession, knowledge of foreign languages, proposed programme of stay and the approximate date of arrival.

After obtaining consent for the visit, the sending party will inform at least two weeks in advance the Receiving Party about the exact time of arrival and means

of transportation.

Strona wysy∏ajàca przeka˝e Stronie przyjmujàcej

wszelkie niezb´dne informacje dotyczàce wystawy co

najmniej na trzy miesiàce przed uzgodnionym terminem jej otwarcia. Eksponaty powinny zostaç dostarczone na miejsce ekspozycji w warunkach dogodnych

dla obu Stron.

The Sending Party will transmit to the Receiving

Party all necessary information relative to the exhibition at least three months before agreed date of its

opening. Exhibits should be delivered to the exhibition site on conditions convenient to both Parties.

Article 15

Program wejdzie w ˝ycie w dniu podpisania i pozostanie w mocy do dnia 31 grudnia 2007 r. Warunki

finansowe okreÊlone w za∏àczniku stanowià integralnà

cz´Êç programu.

This Programme will enter into force on the day it

is signed and will remain effective until the 31st of December 2007. The financial conditions set forth in the

Exhibit constitute an integral part of this Programme.

SPORZÑDZONO w New Delhi dnia 15 marca

2005 r. w dwóch oryginalnych egzemplarzach, ka˝dy

w j´zykach polskim, hindi i angielskim, przy czym

wszystkie teksty posiadajà jednakowà moc. W razie

rozbie˝noÊci przy ich interpretacji tekst w j´zyku angielskim b´dzie rozstrzygajàcy.

DONE in New Delhi, on March 15, 2005 in two originals, each in Hindi, Polish and English, all texts being equally valid. In case of divergences in their interpretation, the English text shall prevail.

The Parties have agreed the following financial

terms of exchange in the framework of this Programme

I. Wizyty krótkoterminowe przy wymianie osobowej

persons (up to 30 days)

nast´pujàcych zasadach

Unless otherwise decided by the interested institutions, the costs of exchange of artists will be covered

on the following terms

1) Strona wysy∏ajàca pokrywa koszty transportu

w obie strony wyposa˝enia sceny i filmów;

1) the Sending Party will cover the cost of return

transport of stage equipment and of films;

2) Strona przyjmujàca pokrywa koszty organizacji

wyst´pów i przedstawieƒ, w tym koszty transportu wyposa˝enia sceny na swoim terytorium;

2) the Receiving Party will cover costs of the organization of performances and plays, including the

costs of transport of stage equipment on its territory;

3) koszty przejazdu i pobytu artystów pokrywa si´ na

zasadach okreÊlonych w cz´Êci I za∏àcznika.

3) costs of travel and stay of artists will be covered

on the principles set forth in part I of the Exhibit.

Je˝eli zainteresowane instytucje nie postanowià

inaczej, koszty wymiany wystaw pokrywane b´dà na

nast´pujàcych zasadach

Unless otherwise decided by the interested institutions, the costs of exchange of exhibitions will be covered on the following terms

1) Strona wysy∏ajàca pokrywa koszty transportu wystawy do pierwszego miejsca ekspozycji w kraju

przyjmujàcym i z powrotem. W Republice Indii

pierwszym i ostatnim miejscem ekspozycji b´dzie

jedno z trzech miast: New Delhi, Bombaj lub Kalkuta;

1) the Sending Party will cover the costs of transport

of the exhibition to and from the first exhibition site in the Receiving Country. In the Republic of India, the first and the last exhibition site will be one

of the three cities: New Delhi, Mumbai and Kolkata;

2) Strona przyjmujàca pokrywa koszty organizacji

wystawy, ochrony, promocji i reklamy. Warunki

2) the Receiving Party will cover the costs of organization of exhibitions, protection, promotion and

publicity. The terms of covering the costs of printing catalogues and posters will be defined in a separate agreement;

3) Strona wysy∏ajàca pokrywa w ca∏oÊci koszty ubezpieczenia wystawy w okresie, gdy znajduje si´ ona

poza terytorium jej kraju. W przypadku utraty lub

uszkodzenia eksponatów Strona przyjmujàca dostarczy Stronie wysy∏ajàcej pe∏nà dokumentacj´

sprawy, aby umo˝liwiç jej uzyskanie odszkodowania od instytucji ubezpieczajàcej. Uszkodzone eksponaty nie mogà byç naprawiane bez uprzedniej

zgody Strony wysy∏ajàcej;

3) the Sending Party will cover full costs of insurance of the exhibition in the period when it is outside the territory of its country. In the event of loss

or damage to the exhibits, the Receiving Party will

deliver all the documents pertaining to the case to

the Sending Party, in order to enable it to obtain

indemnity from the insuring organization. Damaged exhibits may not be repaired without prior authorization by the Sending Party;

Koszty wymiany publikacji, czasopism i innych

materia∏ów przewidzianych programem pokrywa

The costs of exchange of publications, periodicals

and other materials foreseen by the Programme will

be covered fully by the Sending Institution.
