States of America, which was signed on 1 July 1988

and entered into force on 30 August 1988;

COSPAS-SARSAT Programme Agreement on 6 January 1992 that it was maintaining all reghts and obligations of the former Union of Soviet Socialist Republics in the International COSPAS-SARSAT Programme;

RECOGNIZING that it is therefore desirable that

States non-Parties to the International COSPAS-SARSAT Programme Agreement cooperate with the

Parties to this Agreement and with other States, on

a non-discriminatory basis, in the establishment and

operation of COSPAS-SARSAT Ground Segment

equipment and in the use of the COSPAS-SARSAT

System in support of search and rescue operations,

Agrees as follows

1. Definicje

1. Definitions

— „Umowa” oznacza Mi´dzynarodowà Umow´ Programowà COSPAS-SARSAT;

— ”Agreement” means the International COSPAS-SARSAT Programme Agreement;

— „Strony COSPAS-SARSAT” oznaczajà Strony niniejszej Umowy;

— ”COSPAS-SARSAT Parties” means the Parties to

the Agreement;

— „Program” oznacza takie dzia∏ania wykonywane

przez Strony COSPAS-SARSAT zgodnie z warunkami Umowy, które zapewniajà dzia∏anie i koordynacj´ Systemu COSPAS-SARSAT zgodnie z tà

Umowà;

— ”Programme” means those activities carried out

by the COSPAS-SARSAT Parties under the terms

of the Agreement, to provide, operate and co-ordinate the COSPAS-SARSAT System in

accordance with the Agreement;

— „System” oznacza System COSPAS-SARSAT

obejmujàcy segment orbitalny, segment naziemny i radiolatarnie ratunkowe, zgodnie z zapisem

w artykule 3 Umowy, a obejmujàce wyposa˝enie

segmentu naziemnego i radiolatarnie ratunkowe

dostarczane przez Dostawców segmentu naziemnego oraz Paƒstwa U˝ytkowników zgodnie z warunkami Umowy;

— ”System” means the COSPAS-SARSAT System

comprising a Space Segment, a Ground Segment

and Radiobeacons, all as described in Article 3 of

the Agreement, and including Ground Segment

equipment and Radiobeacons provided by

Ground Segment Providers und User States

under the terms of the Agreement;

— „Rada” oznacza Rad´ utworzonà stosownie do

postanowieƒ Umowy;

— ”Council” means the Council

pursuant to the Agreement;

— „Sekretariat” oznacza Sekretariat utworzony stosownie do postanowieƒ Umowy;

— ”Secretariat” means the Secretariat established

pursuant to the Agreement;

— „Dostawca segmentu naziemnego” oznacza ka˝de Paƒstwo, które tworzy i obs∏uguje wyposa˝enie segmentu naziemnego oraz samo korzysta

z Systemu w ramach Umowy;

— ”Ground Segment Provider” means any State

which establishes and operates Ground Segment

equipment and avails itself of the System, under

the terms of the Agreement;

— „Paƒstwo U˝ytkownik” oznacza Paƒstwo, które

samo korzysta z Systemu w ramach Umowy;

— ”User State” means any State that avails itself of

the System under the terms of the Agreement;

— „Agencja” oznacza organizacj´ wyznaczonà przez

Dostawc´ segmentu naziemnego lub Paƒstwo

U˝ytkownika w celu realizacji zadaƒ zwiàzanych

z przystàpieniem do Programu;

— ”Agency” means an organization designated by

a Ground Segment Provider or a User State for

the purpose of implementing its responsibilities

in its association with the Programme;

— „Sygnatariusz” oznacza Paƒstwo, które zgodnie

z warunkami niniejszej noty powiadamia jednego

z Depozytariuszy Umowy o swoim przystàpieniu

do Programu jako Paƒstwo U˝ytkownik.

— ”Signatory” means the State which, under the

terms of this letter, notifies one of the

Depositaries of the Agreement of its association

with the Programme as a User State.

with the standards and procedures established

for the Programme, the objectives of the

2. 2. Aby wdro˝yç powy˝sze cele, Sygnatariusz powinien przystàpiç do Programu jako Paƒstwo U˝ytkownik i wykorzystywaç System we wspieraniu

operacji poszukiwania i ratownictwa poprzez odbiór z Systemu COSPAS-SARSAT sygna∏u alarmowego, danych o po∏o˝eniu oraz poprzez lokalizowanie radiolatarni ratunkowych.

International Maritime Organization and the

International Civil Aviation Organization,

concerning search and rescue; and

b) Cooperate with other national authorities and

relevant international organizations in the

operation and co-ordination of the System.

2. 2. In order to implement these objectives, the

Signatory shall associate itself with the

Programme as a User State and shall utilize the

System in support of search and rescue

operations through the reception of COSPAS-SARSAT alert and location data and through the

deployment of Radiobeacons.

2. 3. Sygnatariusz przyjmuje, ˝e w niniejszej nocie nie

ma klauzuli, która wykracza poza warunki Umowy podpisanej mi´dzy Stronami COSPAS-SARSAT.

2. 3. The Signatory accepts that no provision in this

letter of notification shall commit the COSPAS-SARSAT Parties beyond the terms of the

Agreement.

3. Wykaz odpowiedzialnoÊci Sygnatariusza

3. 1. Zgodnie z postanowieniami Umowy dotyczàcymi uczestnictwa w Programie Paƒstw U˝ytkowników, Sygnatariusz przyjmie odpowiedzialnoÊç

za

a) powiadomienie Rady lub w∏aÊciwej organizacji

mi´dzynarodowej o swoim punkcie kontaktowym dla celów informowania o zagro˝eniu;

b) wykorzystanie do dzia∏ania w Systemie radiolatarni ratunkowych, których charakterystyki

sà zgodne z odpowiednimi wymaganiami Mi´dzynarodowego Zwiàzku Telekomunikacyjnego i wymaganiami COSPAS-SARSAT;

c) prowadzenie, w stosownych przypadkach, rejestru radiolatarni ratunkowych;

d) wymian´ danych COSPAS-SARSAT w odpowiednim czasie i w sposób pozbawiony jakiejkolwiek dyskryminacji, zgodnie z procedurami

uzgodnionymi z Radà;

e) uczestniczenie, kiedy jest to konieczne, w odpowiednich posiedzeniach struktur organizacyjnych Programu, zwo∏ywanych przez Rad´,

w∏àcznie z posiedzeniami otwartymi Rady i jej

podleg∏ych organów, w celu rozwiàzania istotnych problemów administracyjnych, operacyjnych i technicznych;

f) spe∏nienie wszystkich innych wymagaƒ, jakie

mogà zostaç uzgodnione z Radà.

3. 1. In accordance with provisions of the Agreement

concerning the association of User States with

the Programme, the Signatory shall assume the

following responsibilities

a) to advise the Council or the competent

international organization of its point of

contact for distress alert purposes;

b) to make use of radiobeacons for operation in

the System, the characteristics of which

comply with appropriate provisions of the

International Telecommunication Union and

COSPAS-SARSAT Specifications;

c) to maintain, as applicable, a radiobeacon

register;

d) to exchange COSPAS-SARSAT data in a timely

and non-discriminatory manner, in accordance

with procedures agreed with the Council;

3. 2. Niniejsza nota nie b´dzie rozumiana jako powierzanie Sygnatariuszowi, bez jego wczeÊniejszej

zgody, jakiegokolwiek zobowiàzania b´dàcego

poza jej zakresem lub jako zmiana jakiegokolwiek

istniejàcego zobowiàzania, a tak˝e nie b´dzie si´

wymagaç od Sygnatariusza wykonywania nowego zobowiàzania przed terminem uzgodnionym

z Radà.

3. 2. This notification shall not be interpreted as

committing the Signatory to any obligation

beyond the terms of this letter, or modifications

to any existing obligation, without its prior

consent and the Signatory shall not be required

to carry out any new responsibility, before

a period of time agreed with the Council.

z jego przystàpienia do Programu zgodnie

z punktami 2 i 3 niniejszej noty.

4. 2. The Signatory shall designate an Agency which

shall be responsible for the implementation of its

association with the Programme in accordance

with paragraphs 2 and 3 of this letter of

notification.

4. 3. Sygnatariusz poinformuje Strony COSPAS-SARSAT poprzez Sekretariat, o wyznaczonej

przez siebie Agencji i swoim przedstawicielu na

posiedzenia Programu zwo∏ywane przez Rad´,

do uczestnictwa w których zapraszane sà Paƒstwa U˝ytkownicy.

4. 3. The Signatory shall inform the COSPAS-SARSAT

Parties, through the Secretariat, of its designated

Agency and of its representative in the meetings

of the Programme convened by the Council, in

which User States are invited to participate.

4. 4. Sygnatariusz poinformuje Strony COSPAS-SARSAT, poprzez Sekretariat, o wszelkich kolejnych zmianach przedstawiciela i wyznaczonej

przez siebie Agencji.

4. 4. The Signatory shall inform the COSPAS-SARSAT

Parties, through the Secretariat, of any

subsequent changes of its designated Agency

and representative.

4. 5. Sygnatariusz przyjmuje, ˝e uczestniczenie jego

przedstawiciela w posiedzeniach Programu b´dzie zgodne ze stosownymi przepisami i procedurami przyj´tymi przez Rad´.

4. 5. The Signatory accepts that the participation of its

representative in the meetings of the Programme

shall be in accordance with the applicable

provisions of the International COSPAS-SARSAT

Programme Agreement and the applicable rules

of procedure adopted by the Council.

5. OdpowiedzialnoÊç

5. Liability

5. 1. Sygnatariusz zgadza si´, ˝e Strony lub inne Paƒstwa uczestniczàce w Programie, nie wystàpià

z ˝adnymi roszczeniami ani nie podejmà dzia∏aƒ

przeciwko sobie za zniszczenia, szkody lub straty

finansowe powsta∏e poza zakresem dzia∏ania lub

jego zaniechania, stosownie do jego uczestniczenia w Programie lub u˝ytkowania Systemu.

5. 1. The Signatory accepts that the Parties and other

States associated with the Programme shall not

make any claim or bring actions against each

other for injury, damage or financial losses

arising out of activities, or lack thereof, pursuant

to its association with the Programme or its use

of the System.

5. 2. Sygnatariusz zgadza si´ na nieponoszenie odpowiedzialnoÊci przez u˝ytkowników Systemu, w∏àczajàc Strony COSPAS-SARSAT, Dostawców segmentu naziemnego i Paƒstwa U˝ytkowników

oraz ka˝dà innà stron´, za jakiekolwiek szkody,

zniszczenia lub straty finansowe, które mogà pojawiç si´ ze wzgl´du na korzystanie z Systemu

przez Sygnatariusza uczestniczàcego w Programie. Sygnatariusz b´dzie wspó∏pracowa∏ ze Stronami COSPAS-SARSAT, Dostawcami segmentu

naziemnego i Paƒstwami U˝ytkownikami w celu

zabezpieczenia si´ przed takimi potencjalnymi

˝àdaniami.

5. 2. The Signatory accepts no liability towards users

of the System, including COSPAS-SARSAT

Parties, Ground Segment Providers und User

States, or any third party, particularly as regards

any claims for injury, damages or financial losses

that may arise from their use of the System or

from the Signatory’s association with the

Programme. The Signatory will cooperate with

COSPAS-SARSAT Parties, Ground Segment

Providers and User States with a view to

protecting themselves from any such potential

claims.

6. Sprawy finansowe

6. Financial matters

6. 1. Sygnatariusz, zgodnie ze swoimi krajowymi procedurami finansowymi i w zale˝noÊci od dost´pnoÊci odpowiednich funduszy, b´dzie w pe∏ni odpowiedzialny za pokrycie wszystkich kosztów

zwiàzanych z zobowiàzaniami wobec Systemu,

okreÊlonymi w punktach 2 i 3 niniejszej noty.

6. 1. The Signatory, in conformity with its domestic

funding procedures and subject to the

availability of appropriated funds, shall be fully

responsible for financing all costs associated

with its contribution to the System as defined in

paragraphs 2 and 3 of this letter of notification.

6. 2. Zgodnie z artyku∏em 6 Umowy, Sygnatariusz jest

gotowy wnieÊç standardowà kwot´ rocznà, okreÊlonà co pewien czas przez Rad´, w uzgodnieniu

z Paƒstwami nieb´dàcymi Stronami, a uczestniczàcymi w Programie, na pokrycie wspólnych

kosztów zwiàzanych z organizowaniem, zarzàdzaniem i koordynacjà Programu.

6. 2. In accordance with Article 6 of the Agreement,

the Signatory is prepared to contribute the

standard annual amount, determined from time

to time by the Council in agreement with Non-Party States associated with the Programme,

towards the common costs associated with the

organization, administration and co-ordination

of the Programme.

6. 3. Zgodnie z artyku∏em 6 Umowy, wspólne koszty

wymienione w punkcie 6.2 niniejszej noty nie zawierajà ˝adnych kosztów zwiàzanych z odbiorem

i przesy∏aniem danych o zagro˝eniu przez segment orbitalny COSPAS-SARSAT, które sà dostarczane przez Strony COSPAS-SARSAT wszystkim Paƒstwom bezp∏atnie.

6. 3. In accordance with Article 6 of the Agreement,

common costs refered to in paragraph 6.2 of this

letter of notification do not include any costs

associated with the reception and transmission

of distress alert data through the COSPAS-SARSAT Space Segment, which are provided by

the COSPAS-SARSAT Parties free of charge to all

States.

7. WejÊcie w ˝ycie i okres obowiàzywania

7. Entry into force and termination

7. 1. Przystàpienie Sygnatariusza do Programu jako

Paƒstwo U˝ytkownik b´dzie skuteczne po up∏ywie 30 dni od dnia, w którym nota niniejsza zostanie odebrana przez jednego z Depozytariuszy

Umowy.

7. 1. The association of the Signatory with the

Programme as a User State shall be effective

30 days after the date on which this letter of

notification is received by one of the

Depositaries of the Agreement.

7. 2. Sygnatariusz mo˝e jednostronnie zakoƒczyç

uczestniczenie w Programie przez powiadomienie jednego z Depozytariuszy Umowy o swoim

zamiarze. Takie zakoƒczenie uczestnictwa b´dzie

skuteczne po up∏ywie 180 dni od dnia odbioru

notyfikacji przez tego Depozytariusza Umowy.

Sygnatariusz powinien poinformowaç, poprzez

Sekretariat, Strony COSPAS-SARSAT o zamiarze

jednostronnego zakoƒczenia swojego uczestnictwa w Programie.

7. 2. The Signatory may terminate unilaterally its

association with the Programme by notifying

one of the Depositaries of the Agreement of its

intent to do so. Such termination shall take effect

180 days after the date of receipt of the

notification by this Depositary of the Agreement.

The Signatory shall inform the COSPAS-SARSAT

Parties through the Secretariat of its intent to

terminate unilaterally its association.

7. 3. Sygnatariusz przyjmuje do wiadomoÊci, ˝e o ile

jego uczestnictwo w Programie nie zostanie zakoƒczone zgodnie z punktem 7.2 niniejszej noty,

pozostanie ono w mocy a˝ do zakoƒczenia obowiàzywania Umowy. W tym przypadku uczestnictwo Sygnatariusza w Programie zostanie zakoƒczone z mocà prawa.

7. 3. The Signatory accepts that, unless terminated in

accordance with paragraph 7.2 of this letter of

notification, its association with the Programme

shall remain effective until the Agreement ceases

to be in force, in which case the Signatory’s

association with the Programme will be

automatically terminated.

7. 4. Depozytariuszami Mi´dzynarodowej Umowy

Programowej COSPAS-SARSAT sà wspólnie Sekretarz Generalny Organizacji Mi´dzynarodowego Lotnictwa Cywilnego i Sekretarz Generalny

Mi´dzynarodowej Organizacji Morskiej; Depozytariuszem niniejszej noty jest Sekretarz Generalny Organizacji Mi´dzynarodowego Lotnictwa Cywilnego, który jest proszony o poinformowanie

Stron COSPAS-SARSAT i drugiego Depozytariusza o dacie odbioru obecnej i kolejnej noty przes∏anej przez Sygnatariusza oraz o rozes∏anie ich

kopii do Stron COSPAS-SARSAT i drugiego Depozytariusza.

7. 4. The Depositaries of the International COSPAS-SARSAT Programme Agreement are jointly the

Secretary General of the International Civil

Aviation Organization and the Secretary General

of the International Maritime Organization; the

Depositary referred to in this letter of notification

is the Secretary General of the International Civil

Aviation Organization who is requested to

inform the COSPAS-SARSAT Parties and the

other Depositary of the date of receipt of the

present and subsequent notifications by the

Signatory and to transmit to each of them one

copy of the present and subsequent notifications

by the Signatory.

udzieli∏a w dniu 25 kwietnia 2005 r. zgody na zwiàzanie Rzeczypospolitej Polskiej Notà o przystàpieniu do

Programu Mi´dzynarodowego COSPAS-SARSAT jako
