mi´dzy Rzàdem Rzeczypospolitej Polskiej

a Rzàdem Republiki S∏owackiej

o wspó∏pracy naukowo-technicznej

between the Government of the Republic of Poland

and the Government of the Slovak Republic

on the scientific and technological cooperation

S∏owackiej (zwane dalej „Stronami”),

The Government of the Republic of Poland and the

Government of the Slovak Republic (hereinafter

referred to as ”Parties”),

uznajàc znaczenie wspó∏pracy mi´dzynarodowej

w dziedzinie nauki i techniki dla rozwoju gospodarki

narodowej obu paƒstw,

Recognising the importance of international cooperation in science and technology for the

development of their national economies and

prosperity of both countries,

pragnàc wspieraç i rozwijaç wspó∏prac´ w dziedzinie nauki i techniki na zasadach równoÊci i wzajemnych korzyÊci,

Desiring to support and develop their cooperation

in the areas of science and technology on the basis of

equality and mutual benefit,

uzgodni∏y, co nast´puje

Have agreed as follows

Artyku∏ 1

Article 1

1. Strony b´dà u∏atwiaç i popieraç wspó∏prac´

w dziedzinie nauki i techniki, zgodnie z postanowieniami niniejszej umowy.

1. The Parties shall develop and support the cooperation in the field of science and technology

according to the provisions of this Agreement.

2. Strony b´dà wspieraç wspó∏prac´ w dziedzinie

nauki i techniki realizowanà poprzez bezpoÊrednie

kontakty mi´dzy jednostkami naukowymi, w tym mi´dzy szko∏ami wy˝szymi, jednostkami badawczo-rozwojowymi oraz stowarzyszeniami naukowymi obu

krajów.

2. The Parties shall support the cooperation in

science and technology realized through direct

contacts between scientific units including schools of

higher education, research and development units

and scientific associations of the of the two countries.

3. Strony b´dà wspieraç w jak najszerszym zakresie rozwój wspó∏pracy w dziedzinie badaƒ i techniki

mi´dzy przedsi´biorstwami.

3. Parties shall support collaboration in the field of

research and technology between enterprises to the

maximum possible extent.

Artyku∏ 2

Article 2

Zgodnie z umowà, wspó∏praca w dziedzinie nauki

i techniki b´dzie obejmowaç

According to this Agreement, cooperation in the

field of science and technology shall comprise

1) wspólne projekty naukowo-techniczne i badawczo-rozwojowe;

1) Joint scientific and technological, research and

development projects;

2) wymian´ naukowców, specjalistów, badaczy i ekspertów;

2) Exchange of scientists, specialists, researchers

and experts;

3) wymian´ informacji i dokumentacji naukowej

i technicznej, jak te˝ próbek laboratoryjnych

i sprz´tu na potrzeby wspólnie prowadzonej dzia∏alnoÊci;

3) Exchange of scientific and technological

information, documentation, as well as laboratory

samples and equipment needed for cooperative

activities;

4) wspólne konferencje naukowe, sympozja, warsztaty, inne spotkania oraz wystawy;

4) Joint

scientific

conferences,

symposia,

workshops, other meetings and exhibitions;

5) inne formy wspó∏pracy, które mogà zostaç uzgodnione przez Strony.

5) Other forms of cooperation which can be mutually

agreed upon by the Parties.

Artyku∏ 3

Article 3

1. W celu realizacji umowy powo∏uje si´ Wspólnà

komisj´ do spraw wspó∏pracy w dziedzinie nauki

i techniki (zwanà dalej „Wspólnà Komisjà”), sk∏adajàcà si´ z jednakowej liczby przedstawicieli organów

w∏aÊciwych do zapewnienia realizacji umowy, zgodnie

z artyku∏em 12 umowy.

1. For the purpose of the implementation of this

Agreement a Joint Committee for Cooperation in the

Field of Science and Technology (hereinafter referred

to as ”Joint Committee”) is established, consisting of

equal number of representatives of the bodies

responsible for the implementation of this

Agreement, according to the Article 12 herein.

2. Wspólna Komisja b´dzie spotyka∏a si´ co najmniej raz w roku, o ile nie zostanie to uzgodnione inaczej, na przemian w Rzeczypospolitej Polskiej i w Republice S∏owackiej, w uzgodnionych terminach.

2. The Joint Committee will meet at least once

a year, unless otherwise agreed, alternately in the

Republic of Poland and in the Slovak Republic on

mutually agreed dates.

3. Podczas pierwszego posiedzenia Wspólna Komisja ustali regulamin pracy zapewniajàcy jej sprawne funkcjonowanie.

3. On the first meeting the Joint Committee will

establish the regulations of work, to ensure its

effective functioning.

Artyku∏ 4

Article 4

Do zadaƒ Wspólnej Komisji nale˝eç b´dzie

The tasks of the Joint Committee shall be

following

1) uzgadnianie dziedzin wspó∏pracy;

1) agreement on the areas of cooperation;

2) stanowienie sprzyjajàcych warunków dla wprowadzenia w ˝ycie umowy;

2) creation of favourable conditions

implementation of this Agreement;

3) u∏atwianie i wspieranie realizacji wspólnych programów i projektów;

3) facilitation and support of the implementation of

joint programmes and projects;

4) wymiana doÊwiadczeƒ p∏ynàcych z dwustronnej

wspó∏pracy naukowo-technicznej oraz ocena propozycji dalszego rozwoju tej wspó∏pracy;

4) exchange of experience arising from the bilateral

scientific and technological cooperation and

examination of proposals for further development

of this cooperation;

5) negocjacje i uzgadnianie programów wykonawczych;

5) negotiation of and agreement on Executive

Programmes;

6) opracowywanie protoko∏ów prezentujàcych wyniki wspó∏pracy naukowo-technicznej realizowanej

w ramach umowy.

6) elaboration of protocols presenting results of

scientific & technological cooperation under this

Agreement.

Artyku∏ 5

Article 5

Wydatki ponoszone w zwiàzku z wymianà osobowà, o której mowa w artykule 2 punkt 2 umowy, wynikajàce z realizacji programów i projektów b´dà pokrywane w nast´pujàcy sposób, je˝eli Strony nie uzgodnià inaczej

The expenses incurred in transferring personnel

referred to in the Article 2 point b of this Agreement,

resulting from realisation of programmes and

projects, shall be covered on the following basis,

unless the Parties agree otherwise

a) Strona wysy∏ajàca pokrywa koszty podró˝y mi´dzy stolicami obu krajów lub — je˝eli b´dzie to

bardziej korzystne — mi´dzy siedzibà wysy∏ajàcej

i przyjmujàcej instytucji,

a) the Sending Party covers the round-trip

transportation costs between the capitals of both

countries, or — if more convenient — between the

seats of sending and host institutions;

b) Strona przyjmujàca pokrywa koszty zakwaterowania, wy˝ywienia i transportu lokalnego, niezb´dne

dla realizacji programów i projektów, na terytorium swego kraju.

b) the Receiving Party covers within its state

territory the costs of lodging, meals and local

transportation

necessary

to

carry

out

programmes and projects.

Article 6

Osoby bioràce udzia∏ w realizacji umowy, jak równie˝ personel, o którym mowa w artykule 8 umowy,

zobowiàzane sà przestrzegaç prawa paƒstwa Strony

przyjmujàcej.

The personnel participating in the implementation

of this Agreement, as well as the personnel

mentioned in the Article 8 herein, is obliged to

observe the law of the State of the Receiving Party.

Artyku∏ 7

Article 7

1. Wykorzystanie w∏asnoÊci intelektualnej b´dàcej

wynikiem realizacji wspó∏pracy w ramach umowy b´dzie ka˝dorazowo uzgadniane mi´dzy wspó∏pracujàcymi instytucjami, które zapewnià jej nale˝ytà i skutecznà ochron´ zgodnie z mi´dzynarodowymi umowami dotyczàcymi praw w∏asnoÊci intelektualnej oraz

z ustawodawstwem paƒstwa, w którym prawa te powsta∏y.

1. The utilisation of intellectual property arising

from the cooperative activities under this Agreement

shall be agreed each time between the cooperating

organisations which will ensure its adequate and

efficient protection according to the international

agreements concerning the intellectual property

rights, as well as in accordance with the legislation of

the state where the property rights originate in.

2. Informacje naukowe i techniczne b´dàce wynikiem wspó∏pracy w ramach niniejszej umowy b´dà

stanowi∏y w∏asnoÊç wspó∏pracujàcych instytucji. Informacje te nie mogà byç udost´pnianie stronom trzecim, je˝eli wspó∏pracujàce instytucje nie uzgodnià tego inaczej w formie pisemnej.

2. Scientific and technological information derived

from the cooperation under this Agreement shall be

possessed by the cooperating institutions. Such

information cannot be made available to third parties,

unless otherwise agreed in writing by the cooperating institutions.

Artyku∏ 8

Article 8

Naukowcy, badacze i instytucje z krajów trzecich

lub organizacji mi´dzynarodowych mogà byç zapraszani za zgodà wspó∏pracujàcych instytucji do uczestnictwa w projektach i programach realizowanych

w ramach umowy. Koszty takiego uczestnictwa b´dà

pokrywane przez zainteresowane instytucje kraju trzeciego lub organizacji mi´dzynarodowej, je˝eli organy

w∏aÊciwe do zapewnienia realizacji umowy, o których

mowa w artykule 12, nie uzgodnià inaczej w formie pisemnej.

Scientists, experts and institutions of third

countries or international organisations may be

invited, upon consent of the cooperating institutions,

to participate in projects and programmes carried out

under this Agreement. The cost of such participation

shall be covered by the interested institutions of

a third country or an international organisation unless

the bodies responsible for the implementation of this

Agreement, according to the Article 12 herein, agree

otherwise in writing.

Artyku∏ 9

Article 9

1. Postanowienia umowy mogà byç zmieniane lub

uzupe∏nianie tylko za zgodà obu Stron. Zmiany i uzupe∏nienia wymagajà zachowania formy pisemnej.

1. The provisions of this Agreement may be

amended or supplemented only upon the consent of

both Parties. Amendments and supplements need to

be done in writing.

2. Wszelkie spory dotyczàce interpretacji lub stosowania umowy b´dà rozstrzygane w drodze konsultacji w ramach Wspólnej Komisji lub przez organy

w∏aÊciwe do zapewnienia realizacji umowy, o których

mowa w artykule 12.

2. Any disputes related to the interpretation or

implementation of this Agreement shall be settled

through consultations within the Joint Committee or

by the bodies responsible for the implementation of

this Agreement, according to the Article 12 herein.

Artyku∏ 10

Article 10

Umowa nie narusza praw i zobowiàzaƒ Stron wynikajàcych z innych umów mi´dzynarodowych zawartych przez ka˝dà ze Stron albo których te paƒstwa sà

Stronà.

This Agreement shall not affect the rights and

obligations of both Parties arising from other

international agreements concluded by either Party,

or those the Parties are members of.

Artyku∏ 11

Article 11

1. Umowa podlega zatwierdzeniu zgodnie z prawem umawiajàcych si´ Stron, co zostanie stwierdzone w drodze wymiany not. Umowa wejdzie w ˝ycie po

up∏ywie trzydziestu dni od dnia przekazania póêniejszej noty o zatwierdzeniu.

1. This Agreement is subject to approval in

accordance with applicable law of either Party, what

shall be stated through exchange of notes. This

Agreement shall enter into force thirty days upon

a consignment of the last notification of this approval.

2. Umowa zawarta jest na czas nieokreÊlony. Ka˝da ze Stron ma prawo do wypowiedzenia umowy

w formie pisemnej. Umowa utraci moc po up∏ywie

6 miesi´cy od dnia dostarczenia drugiej Stronie noty

o wypowiedzeniu.

2. This Agreement shall remain in force for an

indefinite period of time. Each Party can terminate the

Agreement in writing. The validity of the Agreement

expires six months from the date of the consignment

of the notification to the other Party.

3. WygaÊni´cie umowy nie wstrzymuje realizacji

projektów i programów przedsi´wzi´tych w jej ramach, a niezakoƒczonych do dnia wygaÊni´cia umowy.

3. The termination of this Agreement shall not

discontinue implementation of the projects or

programmes undertaken within its framework and not

executed at the time of the termination of this

Agreement.

4. Umowa o bezpoÊredniej wspó∏pracy naukowo-technicznej mi´dzy Ministerstwem Nauki, Szkolnictwa Wy˝szego i Techniki Polskiej Rzeczypospolitej Ludowej a Paƒstwowà Komisjà do spraw Post´pu Naukowo-Technicznego i Inwestycji Czechos∏owackiej

Republiki Socjalistycznej, podpisana w Warszawie

dnia 13 kwietnia 1984 r., utraci moc w dniu wejÊcia

w ˝ycie niniejszej umowy.

4. The agreement on direct scientific and

technological cooperation between State Committee

of

Scientific.

Technological

and

Investment

Development of the Czechoslovak Socialistic Republic

and Ministry of Science, Higher Education and

Technology of the Polish People’s Republic signed in

Warsaw on 13 of April 1984 will be terminated on the

date when this Agreement comes into force.

Artyku∏ 12

Article 12

Organami w∏aÊciwymi do zapewnienia realizacji

umowy sà: w Rzeczypospolitej Polskiej — Minister Nauki i Informatyzacji oraz w Republice S∏owackiej — Ministerstwo Edukacji.

The bodies responsible for the implementation of

this Agreement are: the Minister of Scientific

Research and Information Technology for the

Republic of Poland and the Ministry of Education for

the Slovak Republic.

NINIEJSZÑ UMOW¢ sporzàdzono w Warszawie

dnia 18 listopada 2004 r., w dwóch egzemplarzach,

ka˝dy w j´zykach polskim, s∏owackim i angielskim,

przy czym wszystkie teksty sà jednakowo autentyczne.

W przypadku rozbie˝noÊci przy interpretacji umowy,

tekst angielski b´dzie tekstem rozstrzygajàcym.

DONE at Warsaw on the 18 day of November 2004,

in two original copies, each in Polish, Slovak and

English languages, all being equally authentic. In case

of any divergence in interpretation, the English text is

decisive.
