Ministry of Foreign Affairs of Serbia and

Montenegro presents its compliments to the Embassy

of the Republic of Poland in Belgrade and with

reference to Article 12 of the Agreement between the

Government of the Republic of Poland and the Federal

Government of the Federal Republic of Yugoslavia on

extending a credit, signed on October 16, 2002 in

Warsaw, has the honour to propose on behalf of the

Council of Ministers of Serbia and Montenegro the

following amendments to this Agreement

1. W artykule 1 ust´p 2 zdanie: „Kredyt b´dzie wykorzystany w ciàgu dwóch lat od dnia wejÊcia w ˝ycie niniejszej umowy i okres ten mo˝e zostaç przed∏u˝ony za zgodà obu Umawiajàcych si´ Stron”

zastàpione zostanie zdaniem: „Kredyt b´dzie wykorzystany do dnia 31 grudnia 2005 r. i okres ten

mo˝e zostaç przed∏u˝ony za zgodà obu Umawiajàcych si´ Stron”.

1. In Article 1 paragraph 2 the sentence: ”The credit

will be utilized within two years since the date of

coming into force of the Agreement and this

period may be extended upon a mutual consent

of both Sides of the Agreement” will be replaced

by the sentence: ”The credit will be utilized by

December 31, 2005 and this period may be

extended upon a mutual consent of both Sides of

the Agreement”.

2. W artykule 7 wyrazy: „Sp∏ata ka˝dorazowego wykorzystania kredytu b´dzie nast´powa∏a w 28 równych, pó∏rocznych, kolejnych ratach” zastàpione

b´dà wyrazami: „Sp∏ata ka˝dorazowego wykorzystania kredytu b´dzie nast´powa∏a w 33 równych,

pó∏rocznych, kolejnych ratach”.

2. In Article 7 the words: ”The repayment of each

credit utilization will take place in 28 equal, semi-annual consecutive instalments” will be replaced

by the words: ”The repayment of each credit

utilization will take place in 33 equal, semi-annual

consecutive instalments”.

Je˝eli wymienione propozycje sà do zaakceptowania przez Rzàd Rzeczypospolitej Polskiej, Ministerstwo

Spraw Zagranicznych Serbii i Czarnogóry proponuje,

aby niniejsza nota oraz stosowna odpowiedê Rzàdu

Rzeczypospolitej Polskiej w tej sprawie tworzy∏y Porozumienie mi´dzy Rzàdem Rzeczypospolitej Polskiej

a Radà Ministrów Serbii i Czarnogóry w sprawie

zmian do Umowy mi´dzy Rzàdem Rzeczypospolitej

Polskiej a Federalnym Rzàdem Federalnej Republiki

Jugos∏awii o udzieleniu kredytu, podpisanej w dniu

16 paêdziernika 2002 r. w Warszawie. Niniejsze porozumienie wejdzie w ˝ycie w dniu otrzymania noty stanowiàcej odpowiedê Rzàdu Rzeczypospolitej Polskiej

przez Stron´ serbskà i czarnogórskà, a stosowane b´dzie poczàwszy od dnia 8 stycznia 2005 r.

If the foregoing proposals are acceptable to the

Government of the Republic of Poland, the Ministry of

Foreign Affairs of Serbia and Montenegro proposes

that this note together with the note constituting the

response of the Government of Poland shall constitute

the Understanding between the Government of the

Republic of Poland and the Council of Ministers of

Serbia and Montenegro on the amendment to the

Agreement between the Government of the Republic

of Poland and the Federal Government of the Federal

Republic of Yugoslavia on extending a credit, signed

on October 16, 2002 in Warsaw. This Agreement shall

enter into force on the day of receipt of the note with

the response of the Government of the Republic of

Poland by the Serbian and Montenegrin Side and shall

take effect on January 8, 2005.

The Ministry of Foreign Affairs of the Republic of

Poland with reference to Article 12 of the Agreement

and the above cited note of the Ministry of Serbia and

Montenegro, dated September 28, 2004 No. 28355

has the honour to convey that the Government of the

Republic of Poland has accepted the above

mentioned proposals and considers that this note and

the note of the Council of Ministers of Serbia and

Montenegro constitutes the Understanding between

the Government of the Republic of Poland and the

Government of Serbia and Montenegro on the

amendment to the Agreement between the

Government of the Republic of Poland and the

Federal Government of the Federal Republic of

Yugoslavia on extending a credit, signed on October 16, 2002 in Warsaw. This Agreement shall come

into force on the date of the receipt of the present

note by the Serbian and Montenegrin Side and shall

take effect on January 8, 2005.
