a Rzàdem Republiki Korei o wspó∏pracy

w dziedzinie turystyki

on tourism cooperation between the Government

of the Republic of Poland and the Government

of the Republic of Korea

Rzàd Rzeczypospolitej Polskiej i Rzàd Republiki

Korei, zwane dalej „Stronami”,

The Government of the Republic of Poland and

the Government of the Republic of Korea (hereinafter

referred to as “the Parties”),

— pragnàc przyczyniç si´ do dalszego rozszerzania istniejàcych przyjacielskich kontaktów mi´dzy

oboma paƒstwami,

Wishing to further promote the friendly relations

existing between the two countries,

— Êwiadome znaczenia turystyki dla rozwoju stosunków gospodarczych i kulturalnych oraz lepszego

poznania ˝ycia, historii i dziedzictwa kulturowego narodów Rzeczypospolitej Polskiej i Republiki Korei,

Conscious of the importance of tourism for the

development of their economic and cultural relations,

as well as the better understanding of the life, history

and cultural heritage of nations of the Republic of

Poland and the Republic of Korea,

— uznajàc potrzeb´ stworzenia podstaw prawnych dla wspó∏pracy w dziedzinie turystyki,

uzgodni∏y, co nast´puje

Acknowledging the need for creating a legal basis

for cooperation in the field of tourism,

Have agreed as follows

Artyku∏ 1

Article 1

Strony, zgodnie z postanowieniami niniejszej umowy oraz prawem obowiàzujàcym na terytoriach Rzeczypospolitej Polskiej i Republiki Korei, b´dà umacniaç

i rozwijaç wspó∏prac´ w dziedzinie turystyki w celu lepszego poznania historii i kultury obu narodów.

The Parties shall, subject to respective laws and

regulations of the Republic of Poland and the Republic

of Korea, strengthen and develop co-operation in the

field of tourism with a view of promoting a better

understanding of the history and culture of their nations.

Artyku∏ 2

Article 2

Strony b´dà popieraç nawiàzywanie i rozwój

wspó∏pracy pomi´dzy organizacjami i przedsi´biorcami obu paƒstw, uczestniczàcymi w rozwoju turystyki

mi´dzynarodowej, a tak˝e sprzyjaç podejmowaniu inwestycji i wspólnych przedsi´wzi´ç w dziedzinie turystyki przez te organizacje i przedsi´biorców.

The Parties shall support the establishment and

development of cooperation between organisations

and entities of the two countries participating in the

development of international tourism, and shall

encourage investment and joint ventures in the field

of tourism by these organisations and entities.

Artyku∏ 3

Article 3

Wspó∏praca, o której mowa w artykule 2, b´dzie

si´ odbywa∏a w szczególnoÊci poprzez

The cooperation, referred to in Article 2, shall be

realised through the following, in particular

a) podejmowanie wspólnych przedsi´wzi´ç w celu

a) undertaking of joint ventures with the aim of

providing tourism-related services to tourists

from both countries,

b) wymian´ specjalistów w dziedzinie turystyki,

b) exchange of experts in the field of tourism,

c) wymian´ informacji dotyczàcych turystyki,

c) exchange of tourism-related information,

d) pomoc w kszta∏ceniu kadr dla turystyki.

d) assistance in the training of personnel.

Artyku∏ 4

Article 4

Strony b´dà popieraç wymian´ informacji w nast´pujàcych dziedzinach

The Parties shall encourage the exchange of

information in the following areas

a) statystyka turystyczna,

a) tourism statistics;

b) programy kszta∏cenia specjalistów w dziedzinie turystyki,

b) educational programmes in tourism-related areas,

c) materia∏y reklamowe i dzia∏alnoÊç promocyjna

w dziedzinie turystyki,

c) promotional materials and activities in the field of

tourism,

d) regulacje prawne dotyczàce ochrony zasobów turystycznych i dóbr kultury,

d) domestic legislation related to the protection of

tourism resources and cultural heritage,

e) regulacje prawne dotyczàce dzia∏alnoÊci turystycznej.

e) domestic legislation related to the regulation of

tourism activities.

Article 5

Strony b´dà sprzyjaç wymianie specjalistów i pracowników, specjalizujàcych si´ w turystyce, a tak˝e

wspó∏pracy instytucji prowadzàcych badania w dziedzinie turystyki.

The Parties shall facilitate the exchange of experts

and personnel, specializing in the field of tourism, as

well as the cooperation between institutions responsible for conducting research in the field of tourism.

Artyku∏ 6

Article 6

Ka˝da ze Stron b´dzie sprzyjaç powstawaniu na

terytorium swojego paƒstwa oÊrodków informacji turystycznej drugiej Strony.

Each Party shall facilitate the establishment of

tourism information centres of the other Party in its

own territory.

Artyku∏ 7

Article 7

Strony b´dà wymieniaç informacje i dzieliç si´ doÊwiadczeniami zwiàzanymi z ich udzia∏em w pracach

mi´dzynarodowych organizacji turystycznych.

The Parties shall exchange information and share

know-how gained as a result of their participation in

international tourism organisations.

Artyku∏ 8

Article 8

1. Strony utworzà Komisj´ Wspólnà, której zadaniem b´dzie zapewnienie nale˝ytego wykonania postanowieƒ niniejszej umowy oraz rozwiàzywanie problemów mogàcych powstaç w toku jej realizacji.

1. The Parties shall establish a Joint Commission

to be responsible for the effective implementation of

this Agreement and the resolution of any problems

that may arise in the course of its implementation.

2. Komisja Wspólna sk∏adaç si´ b´dzie z wyznaczonych przez Strony przedstawicieli zajmujàcych si´

dzia∏alnoÊcià w dziedzinie turystyki. Komisji b´dà

przewodniczyç przedstawiciele ka˝dej ze Stron.

2. The Joint Commission shall be composed of

representatives involved in the field of tourism and

appointed by the Parties. It shall be co-chaired by

a representative of each Party.

3. Komisja Wspólna zbierze si´ po raz pierwszy

w ciàgu szeÊciu miesi´cy od dnia wejÊcia umowy

w ˝ycie.

3. The Joint Commission‘s first meeting shall be

held within six months of the entry into force of this

Agreement.

4. Komisja Wspólna na swym pierwszym posiedzeniu opracuje regulamin, w którym okreÊli tryb pracy.

4. At its first meeting, the Joint Commission shall

draw up a set of regulations to define the procedures

governing its activities.

5. Komisja Wspólna spotykaç si´ b´dzie w miar´

potrzeby, na pisemny wniosek jednej ze Stron,

na przemian w Rzeczypospolitej Polskiej i Republice

Korei.

Artyku∏ 9

5. The Joint Commission shall meet, as and when

necessary, at the written request of either Party,

alternately in the Republic of Poland and the Republic

of Korea.

Article 9

1. Umowa niniejsza podlega przyj´ciu zgodnie

z prawem paƒstwa ka˝dej ze Stron, co zostanie stwierdzone w drodze wymiany not. Umowa wejdzie w ˝ycie po up∏ywie 30 dni od dnia otrzymania noty póêniejszej.

1. The Parties shall notify each other through

diplomatic channels of the completion of their

domestic procedures necessary for the entry into

force of this Agreement. This Agreement shall enter

into force 30 days after the date of the receipt of the

latter notification.

2. Umowa niniejsza zawarta jest na okres pi´ciu

lat. Ulega ona automatycznemu przed∏u˝eniu na dalsze okresy pi´cioletnie, je˝eli ˝adna ze Stron nie wypowie jej, w drodze notyfikacji, najpóêniej na szeÊç

miesi´cy przed up∏ywem danego okresu wa˝noÊci.

2. This Agreement shall remain in force for an

initial period of five years. It shall be automatically

extended for successive five-year periods, unless it is

terminated by either Party by giving written notice to

the other Party at least six months prior to the expiry

of the relevant five-year period.

3. Wypowiedzenie umowy nie b´dzie mia∏o wp∏ywu na przedsi´wzi´cia podj´te i realizowane zgodnie

z umowà w czasie jej obowiàzywania a˝ do czasu ich

zakoƒczenia.

3. Termination of this Agreement shall be without

prejudice to the duration or validity of any cooperation activities undertaken in accordance with

this Agreement prior to its termination.

NA DOWÓD CZEGO ni˝ej podpisani, odpowiednio

upowa˝nieni przez swoje Rzàdy, podpisali niniejszà

umow´.

IN WITNESS WHEREOF the undersigned, being

duly authorized thereto by their respective

Governments, have signed this Agreement.

SPORZÑDZONO w Warszawie dnia 3 grudnia

2004 r. w dwóch egzemplarzach, ka˝dy w j´zykach

polskim, koreaƒskim i angielskim, przy czym wszystkie teksty sà jednakowo autentyczne. W razie rozbie˝noÊci przy ich interpretacji tekst w j´zyku angielskim

b´dzie uwa˝any za rozstrzygajàcy.

DONE in duplicate at Warsaw on the 3 of

December 2004 in the Polish, Korean and English

languages, all texts being equally authentic. In case of

any divergence of interpretation, the English text shall

prevail.

Na podstawie art. 3 ust. 1 pkt 1 w zwiàzku z art. 5

ust. 1 ustawy z dnia 17 grudnia 1998 r. o zasadach u˝ycia lub pobytu Si∏ Zbrojnych Rzeczypospolitej Polskiej

poza granicami paƒstwa (Dz. U. Nr 162, poz. 1117 oraz

z 2004 r. Nr 210, poz. 2135), na wniosek Rady Ministrów, postanawiam, co nast´puje
