AGREEMENT

mi´dzy Rzàdem Rzeczypospolitej Polskiej

a Rzàdem Republiki Indonezji

o wspó∏pracy kulturalno-edukacyjnej

between the Government of the Republic of Poland

and the Government of the Republic of Indonesia

on cultural and educational co-operation

Rzàd Rzeczypospolitej Polskiej i Rzàd Republiki Indonezji, zwane dalej „Umawiajàcymi si´ Stronami”,

The Government of the Republic of Poland and

the Government of the Republic of Indonesia,

hereinafter referred to as „the Contracting Parties”,

dà˝àc do umocnienia przyjaznych stosunków mi´dzy narodami Polski i Indonezji oraz pragnàc popieraç

i rozwijaç wspó∏prac´ w dziedzinie kultury, edukacji

i sportu oraz w zakresie problematyki zwiàzanej z m∏odzie˝à i Êrodkami masowego przekazu,

Seeking to strengthen the existing relations of

friendship between the peoples of Poland and

Indonesia and desirous of supporting and expanding

their co-operation in the areas of culture, education

and sports, as well as in the scope of problems related

to youth and the mass media,

przekonane, ˝e taka wspó∏praca sprzyja pog∏´bieniu wzajemnego zrozumienia i poznania obu krajów,

Convinced that such co-operation enhances a

further mutual understanding and knowledge of the

two countries,

zgodnie z prawem i przepisami obowiàzujàcymi

Pursuant to the laws and regulations of the two

countries,

Have agreed as follows

Artyku∏ 1

Article 1

Umawiajàce si´ Strony b´dà popieraç wspó∏prac´

i wymian´ doÊwiadczeƒ w dziedzinie kultury, sztuki,

edukacji i sportu oraz w zakresie problematyki zwiàzanej z m∏odzie˝à i Êrodkami masowego przekazu.

The Contracting Parties shall support cooperation and exchanges of experience in the areas of

culture, arts, education and sports, as well as in the

scope of problems related to youth and the mass

media.

Artyku∏ 2

Article 2

W celu upowszechniania znajomoÊci kultury i edukacji drugiego kraju Umawiajàce si´ Strony b´dà popieraç

In order to spread the knowledge of culture and

education of the other country, the Contracting

Parties shall provide support to

a) nawiàzywanie kontaktów mi´dzy zainteresowanymi instytucjami i ekspertami w dziedzinie kultury

i sztuki, wymian´ wizyt artystów i delegacji stowarzyszeƒ twórczych, a tak˝e wymian´ informacji

i materia∏ów dotyczàcych kultury,

a) establishment of contacts between the interested

institutions and experts of culture and art,

exchange of visits by artists and delegations from

artistic associations, as well as exchanges of

cultural-related information and materials,

b) wzajemne organizowanie przedsi´wzi´ç kulturalnych, takich jak wystawy plastyczne, imprezy muzyczne oraz przeglàdy filmowe i teatralne,

b) organisation of cultural events on a reciprocal

basis, including art exhibitions, music events, as

well as film and theatre reviews,

c) wspó∏prac´ mi´dzy archiwami paƒstwowymi, muzeami i bibliotekami,

c) co-operation between state archives, museums

and libraries,

d) wspó∏prac´ na rzecz zachowania materialnego

i niematerialnego dziedzictwa kultury, w tym

wspó∏prac´ mi´dzy instytucjami zajmujàcymi si´

d) co-operation to preserve tangible and intangible

cultural heritage, including co-operation between

institutions responsible for conservation of

artistic

archaeological research,

monuments

and

e) bezpoÊrednià wspó∏prac´ mi´dzy uczelniami,

a tak˝e akademiami nauk oraz zainteresowanymi

placówkami naukowymi obu krajów,

e) direct co-operation between schools of higher

learning, academies of sciences and interested

institutions of both countries,

f) wymian´ wizyt, pobyty studyjne i wyk∏ady specjalistów, w tym naukowców, nauczycieli akademickich oraz nauczycieli.

f) exchange of visits, study visits and lectures by

specialists, including scholars, academic and

school teachers.

Article 3

Umawiajàce si´ Strony b´dà popieraç wspó∏prac´

mi´dzy organizacjami m∏odzie˝owymi, w szczególnoÊci poprzez wymian´ delegacji.

The Contracting Parties shall support co-operation

of youth organisations, in particular exchanges of

delegations.

Artyku∏ 4

Article 4

Umawiajàce si´ Strony b´dà popieraç wspó∏prac´

w dziedzinie kultury fizycznej i sportu.

The Contracting Parties shall support co-operation

in the fields of physical education and sports.

Artyku∏ 5

Article 5

Umawiajàce si´ Strony b´dà popiera∏y wspó∏prac´ mi´dzy publicznymi instytucjami prasowymi, radiowymi i telewizyjnymi.

The Contracting Parties shall encourage co-operation between their public press, radio and

television institutions.

Artyku∏ 6

Article 6

Ka˝da z Umawiajàcych si´ Stron uzna prawa autorskie i prawa pokrewne przys∏ugujàce osobom fizycznym i prawnym drugiej Umawiajàcej si´ Strony

na w∏asnym terytorium, jak te˝ wynikajàce z dzia∏aƒ

wykonywanych w zwiàzku z niniejszà umowà, oraz zagwarantuje ochron´ tych praw w wypadku, gdyby nie

by∏y one chronione przez umowy o charakterze mi´dzynarodowym.

Each of the Contracting Parties shall recognize the

copyrights and its neighbouring rights owned by

persons and legal entities of the other Contracting

Party within its respective territory and any result of

activities which are performed under this Agreement,

and shall also ensure the protection of such rights if

they are not protected by international agreements.

Article 7

Strony b´dà wspó∏pracowaç w celu niedopuszczenia do nielegalnego wwozu, wywozu i przekazywania

dóbr kultury, stanowiàcych ich dziedzictwo kulturalne,

zgodnie z przepisami prawnymi obowiàzujàcymi

w danym kraju, a tak˝e zgodnie z podpisanymi przez

obie Strony odnoÊnymi konwencjami mi´dzynarodowymi.

The Contracting Parties shall co-operate in order

to prevent illegal importation, exportation and

transfer of items belonging to their cultural heritage,

in conformity with the legal regulations of both

countries as well as in conformity with proper

international conventions.

Artyku∏ 8

Article 8

W celu realizacji niniejszej umowy mogà byç

uzgadniane okresowe mi´dzyrzàdowe porozumienia

wymiany kulturalnej i edukacyjnej lub porozumienia

mi´dzy odpowiednimi resortami, w tym ogólne warunki finansowe realizacji tej umowy.

For the purpose of implementation of this

Agreement, intergovernmental protocols may be

periodically negotiated for cultural and educational

exchanges, as well as agreements between the

interested ministries, including general financial

conditions of this Agreement.

Artyku∏ 9

Article 9

W razie potrzeby przedstawiciele Umawiajàcych

si´ Stron b´dà si´ spotykaç, na przemian w ka˝dym

z krajów, w celu oceny realizacji niniejszej umowy

i przygotowania zaleceƒ co do dalszej wspó∏pracy.

As needed, officials of the Contracting Parties shall

meet alternately in each of the countries, to review the

implementation of this Agreement and to prepare

recommendations for their further co-operation.

Artyku∏ 10

Article 10

Umawiajàce si´ Strony ustali∏y, ˝e zainteresowane

instytucje, zajmujàce si´ ró˝nymi dziedzinami niniejszej umowy, mogà zawieraç mi´dzy sobà programy

okresowe okreÊlajàce szczegó∏y ich wspó∏pracy.

The Contracting Parties have agreed that their

respective institutions responsible for various areas

of this Agreement may conclude between themselves

periodical programmes to specify the details of their

co-operation.

Artyku∏ 11

Article 11

Problemy wynikajàce z interpretacji lub realizacji

niniejszej umowy b´dà rozstrzygane polubownie

w drodze konsultacji lub negocjacji mi´dzy Umawiajàcymi si´ Stronami, z wykorzystaniem kana∏u dyplomatycznego.

Any dispute arising out from the interpretation or

implementation of this Agreement shall be settled

amicably by consultation or negotiations between the

Contracting Parties through diplomatic channels.

Artyku∏ 12

Article 12

Wszelkie zmiany dotyczàce treÊci niniejszej umowy b´dà uzgadniane poprzez wymian´ not i wejdà

w ˝ycie w terminie okreÊlonym przez Umawiajàce si´

Strony.

Any amendment related to this Agreement shall

be accorded through the exchange of notes and shall

enter into force on the date to be determined by the

Contracting Parties.

Artyku∏ 13

Article 13

Niniejsza umowa podlega przyj´ciu zgodnie z prawem ka˝dej z Umawiajàcych si´ Stron i wejdzie w ˝ycie z datà otrzymania noty póêniejszej, potwierdzajàcej spe∏nienie niezb´dnych wewn´trznych wymogów

prawnych.

This Agreement shall be subject to approval in

compliance with the law of each of the Contracting

Parties, and shall come into force on the date of

receipt of a latter note, confirming the fulfilment of

domestic legal requirements.

Umowa niniejsza zawarta jest na okres pi´ciu lat,

przy czym ulegnie ona automatycznemu przed∏u˝eniu

na kolejne okresy pi´cioletnie, je˝eli ˝adna z Umawiajàcych si´ Stron nie wypowie jej w drodze notyfikacji

przynajmniej na szeÊç miesi´cy przed up∏ywem kolejnego okresu obowiàzywania.

This Agreement shall be concluded for the period

of five years, and shall be automatically extended for

consecutive five-year periods, unless one of the

Contracting Parties renounces it by means of

notification at least six months prior to the end of the

validity period.

W przypadku wypowiedzenia niniejszej umowy

wszelkie trwajàce programy i projekty b´dà obowiàzywa∏y do czasu ich zakoƒczenia.

In the event of renunciation of this Agreement, all

ongoing programmes and projects shall remain in

force until completion.

NA DOWÓD CZEGO ni˝ej wymienieni podpisali niniejszà umow´ w imieniu swoich Rzàdów.

IN WITNESS WHEREOF, the undersigned, being

duly authorized by their respective Governments,

have signed this Agreement.

SPORZÑDZONO w Warszawie dnia 24 kwietnia

2003 r. w dwóch egzemplarzach, ka˝dy w j´zykach

polskim, indonezyjskim i angielskim, przy czym

wszystkie teksty majà jednakowà moc. W razie rozbie˝noÊci w interpretacji niniejszej umowy tekst w j´zyku angielskim b´dzie uwa˝any za rozstrzygajàcy.

DONE at Warsaw, on this 24th day of April of the

year 2003 in duplicate, of which each shall be in the

Polish, Indonesian and English languages, all texts

being equally authentic. In case of any divergence of

interpretation of this Agreement, the English text

shall prevail.
