AGREEMENT

on cooperation in the field of tourism between the

Government of the Republic of Poland and the

Government of the Republic of Lithuania

Rzàd Rzeczypospolitej Polskiej i Rzàd Republiki Litewskiej, zwane dalej „Umawiajàcymi si´ Stronami”,

The Government of the Republic of Poland and the

Government of the Republic of Lithuania, hereinafter

referred to as ”Contracting Parties”,

— deklarujàc ch´ç wspólnego rozwoju wspó∏pracy

w dziedzinie turystyki mi´dzy obu Paƒstwami na zasadach równoÊci i wzajemnych korzyÊci,

— declaring the common interest to develop the

tourist cooperation between the two countries on the

equal basis and mutual benefit,

— majàc ÊwiadomoÊç znaczenia ruchu turystycznego dla wzajemnego poznania i porozumienia mi´dzy narodami,

— knowledging that tourism is an excellent tool for

mutual acquainted and relationships between nations,

— doceniajàc rol´, jakà ruch turystyczny mo˝e

spe∏niaç przy dalszym umacnianiu stosunków mi´dzy

obu Paƒstwami,

— admitting the role of the tourism as a factor of

strengthening relations between the two countries,

— zgodnie z postanowieniami Traktatu mi´dzy

Rzeczàpospolità Polskà a Republikà Litewskà o przyjaznych stosunkach i dobrosàsiedzkiej wspó∏pracy, sporzàdzonego w Wilnie dnia 26 kwietnia 1994 r.,

— according to the stipulations of the Friendship

and Cooperation Treaty between the Republic of

Poland and the Republic of Lithuania, signed in Vilnius

on April 26th, 1994,

— kierujàc si´ zaleceniami Konferencji Narodów

Zjednoczonych w dziedzinie turystyki i podró˝y mi´dzynarodowych, a tak˝e zaleceniami Aktu koƒcowego

Konferencji Bezpieczeƒstwa i Wspó∏pracy w Europie,

jak równie˝ zaleceniami Âwiatowej Organizacji Turystyki,

— guided by the principles and recommendations

of the United Nations Conference on Tourism and

International Travels, of the Final Document of the

Conference for Security and Cooperation in Europe,

and according to the World Tourism Organization

recommendations,

have agreed on the following

Artyku∏ 1

Article 1

1. Umawiajàce si´ Strony, w celu lepszego zapoznania spo∏eczeƒstw z ˝yciem, historià i kulturà narodów obu Paƒstw, b´dà wspieraç wszelkie formy turystyki i wspó∏pracy turystycznej.

1. The Contracting Parties will support all forms of

tourism and mutual tourist cooperation between the

countries in order to provide for better acquaintance of

the life, history, and culture of the two nations.

2. Wspó∏praca b´dzie realizowana zgodnie z postanowieniami niniejszej umowy i z prawem obowiàzujàcym w ka˝dym z obu Paƒstw.

2. Cooperation will be implemented in accordance

with the provisions of this Agreement and the laws

and regulations that are in effect in the two countries.

Artyku∏ 2

Article 2

Umawiajàce si´ Strony b´dà wspieraç rozwój turystyki zarówno w formach zorganizowanych, jak i indywidualnych. B´dà równie˝ popieraç wymian´ grup

specjalistycznych, dzia∏ajàcych w przemyÊle turystycznym, w tym udzia∏ w mi´dzynarodowych spotkaniach

dotyczàcych turystyki: w kongresach, sympozjach, wystawach, imprezach sportowych, festiwalach muzycznych, teatralnych itp.

The Contracting Parties will support the

development of tourism, both in its organized and its

individual forms. They will also support exchanges of

the specialized groups, including those participating in

congresses, symposiums, exhibitions, sports events,

music festivals, theater festivals, etc.

Article 3

Umawiajàce si´ Strony, zgodnie z prawem obowiàzujàcym w ka˝dym z obu Paƒstw, b´dà stwarzaç warunki do nawiàzywania i umacniania wspó∏pracy mi´dzy polskimi i litewskimi organizacjami, podmiotami

gospodarczymi i stowarzyszeniami uczestniczàcymi

w mi´dzynarodowej turystyce i jej rozwoju.

The Contracting Parties, subject to the laws and

regulations that are in effect in each of the two

countries will create conditions favourable for making

and strengthening cooperation between Polish and

Lithuanian organizations and associations that

participate in the development of international

tourism.

Article 4

Wspó∏praca zainteresowanych podmiotów obu

krajów b´dzie realizowana poprzez

Cooperation will be implemented through the

following

1) podejmowanie wspólnych przedsi´wzi´ç w celu

organizacji obs∏ugi turystów, w tym równie˝ z krajów trzecich,

1) taking up common projects for the purpose of

organizing services for tourists, including those

from third countries,

2) tworzenie i rozwijanie spó∏ek z udzia∏em kapita∏u

zagranicznego,

2) creating and developing companies with foreign

capital participation,

3) tworzenie i rozwijanie infrastruktury niezb´dnej do

realizacji wspó∏pracy turystycznej,

3) creating and developing the infrastructure that is

necessary for the realization of cooperation in

tourism,

4) wspólne inwestycje w dziedzinie turystyki,

4) common investments in the sphere of tourism,

5) wymian´ specjalistów,

5) exchange of specialists,

6) organizowanie wystaw i targów,

6) organizing exhibitions and trade fairs,

7) promowanie form turystyki przyjaznej Êrodowisku,

7) promoting eco-tourism,

8) inne formy wspó∏pracy, b´dàce przedmiotem wzajemnego zainteresowania.

8) other forms of cooperation that are the subject of

mutual interest.

Artyku∏ 5

Article 5

Umawiajàce si´ Strony, zgodnie z prawem obowiàzujàcym w ka˝dym z obu Paƒstw, b´dà dà˝yç do

uproszczenia formalnoÊci dotyczàcych przekraczania

granicy paƒstwowej, celnych oraz innych zwiàzanych

z turystycznà wymianà mi´dzy obydwoma Paƒstwami, a tak˝e staraç si´ stworzyç warunki zapewniajàce

bezpieczeƒstwo turystom drugiej Umawiajàcej si´

Strony podczas pobytu na terytorium swoich Paƒstw.

The Contracting Parties, subject to the laws and

regulations that are in effect in each of the two

countries, will direct their efforts at simplifying border,

customs and other formalities relating to tourism

exchanges between the two countries and make

efforts towards creating conditions that would ensure

the safety of tourists from one country during their

visit within the territory of the other country.

Artyku∏ 6

Article 6

1. Wszystkie rozliczenia i p∏atnoÊci mi´dzy polskimi i litewskimi podmiotami z tytu∏u dzia∏alnoÊci turystycznej b´dà dokonywane w walutach wymienialnych.

1. All accounting and payments in connection with

tourist activities made between the Polish and

Lithuanian organizations will be made in convertible

currencies.

2. W trybie porozumienia mi´dzy w∏aÊciwymi organami obu Paƒstw rozliczenia i p∏atnoÊci mogà byç

dokonywane w innej formie, zgodnie z prawem obowiàzujàcym w ka˝dym z obu Paƒstw.

2. Pending agreement between competent

authorities of the two countries, accounting and

payments may be made in other forms, subject to laws

and regulations that are in effect in the two countries.

Artyku∏ 7

Article 7

W∏aÊciwe instytucje obydwu Paƒstw b´dà dokonywaç wymiany informacji dotyczàcych turystyki z zakresu

Competent institutions of the two countries will

exchange information pertaining to the following

issues related to tourism

1) uregulowaƒ prawnych obowiàzujàcych w sferze

wspó∏pracy turystycznej z zagranicà,

1) legal regulations in effect for the sphere of

cooperation in tourism with other countries,

2) uregulowaƒ prawnych zwiàzanych z zachowaniem

zasobów naturalnych oraz dóbr kultury stanowiàcych walory turystyczne,

2) legal regulations related to conserving natural

resources and cultural goods that at the same time

constitute tourist attractions,

3) danych statystycznych oraz stanu rynku turystycznego,

3) statistical data and the state of the tourist market,

4) informacji i materia∏ów o charakterze propagandowym i naukowo-badawczym (prospekty, foldery,

broszury, kalendarze, reklamowe filmy turystyczne

itp.).

4) information and materials of an advertising and

scientific research nature (prospects, pamphlets,

brochures, calendars, tourist advertising spots,

films, etc.).

Article 8

Umawiajàce si´ Strony b´dà popieraç wzajemnà

wspó∏prac´ w zakresie kszta∏cenia kadr dla turystyki,

wymian´ pracowników naukowych, specjalistów,

dziennikarzy, a tak˝e dzia∏alnoÊç instytucji prowadzàcych badania w dziedzinie turystyki.

Artyku∏ 9

The Contracting Parties will support mutual

cooperation in the sphere of educating and training

staffs for tourism, exchanges of scientific workers,

specialists, journalists and also cooperation between

institutions conducting studies in the sphere of

tourism.

Article 9

1. Umawiajàce si´ Strony, zgodnie z prawem obowiàzujàcym w ka˝dym z obu Paƒstw, b´dà przyczyniaç

si´ do tworzenia sprzyjajàcych warunków dla organizacji i dzia∏alnoÊci Narodowych OÊrodków Informacji

Turystycznej, b´dàcych na terytorium Paƒstwa drugiej

Umawiajàcej si´ Strony oficjalnymi przedstawicielstwami resortów zajmujàcych si´ turystykà.

1. The Contracting Parties, subject to laws and

regulations that are in effect in each of the two

countries, will contribute to creating appropriate

conditions for the organization and activites of

National Tourist Information Centers, which are their

official representatives within the State territory of the

other Contracting Party.

2. Zagadnienia zwiàzane z otwarciem i funkcjonowaniem oÊrodków b´dà uzgadniane mi´dzy organami

do spraw turystyki obu Umawiajàcych si´ Stron.

2. Issues related to the opening and functioning of

representative offices will be agreed upon between

authorities of state administration responsible for

tourism issues of the Contracting Parties.

Artyku∏ 10

Article 10

Umawiajàce si´ Strony b´dà rozwijaç wspó∏prac´

na forum mi´dzynarodowych organizacji turystycznych.

The Contracting Parties will develop cooperation

on a base of international tourist organizations.

Artyku∏ 11

Article 11

1. Umawiajàce si´ Strony utworzà wspólnà Komisj´ Mieszanà, sk∏adajàcà si´ z przedstawicieli obu

Umawiajàcych si´ Stron, której zadaniem b´dzie okresowy przeglàd realizacji postanowieƒ niniejszej umowy oraz poszukiwanie rozwiàzywania praktycznych

problemów, jakie mogà powstaç w toku wzajemnej

wspó∏pracy.

1. The Contracting Parties agree to create a Joint

Committee, made up of representatives from both

Contracting Parties, which will be responsible for

analyzing the degree to which the provisions of this

Agreement are implemented and to search for

solutions to problems that may arise within the

process of mutual cooperation.

2. Komisja zbieraç si´ b´dzie w razie potrzeby, na

przemian w Polsce i na Litwie, po wczeÊniejszym

uzgodnieniu.

2. The Committee will meet alternate between

Poland and Lithuania.

Artyku∏ 12

Article 12

Umawiajàce si´ Strony b´dà informowaç si´

wzajemnie o nowych dokumentach mi´dzynarodowych z dziedziny turystyki przyj´tych przez jednà

z Umawiajàcych si´ Stron, mogàcych dotyczyç interesów drugiej Umawiajàcej si´ Strony.

The Contracting Parties will inform themselves of

all new international documents in the sphere of

tourism accepted by the one of the Contracting Parties

and which could exert an influence on the interests of

the other Contracting Party.

Artyku∏ 13

Article 13

1. Umowa niniejsza podlega przyj´ciu zgodnie

z prawem wewn´trznym Paƒstwa ka˝dej z Umawiajàcych si´ Stron.

1. This Agreement is subject to acceptance in

accordance with the national legislation of the

Contracting Parties.

2. Umowa niniejsza wejdzie w ˝ycie w dniu otrzymania noty póêniejszej, którà jedna z Umawiajàcych

Artyku∏ 14

Article 14

1. Umowa niniejsza zawarta jest na okres 5 lat. Ulega ona automatycznemu przed∏u˝eniu na dalsze 5-letnie okresy, je˝eli ˝adna z Umawiajàcych si´ Stron nie

wypowie jej w drodze notyfikacji na szeÊç miesi´cy

przed up∏ywem danego okresu wa˝noÊci.

1. This Agreement will remain in force for a period

of 5 years and it shall be automatically renewed for

further additional 5-years periods, unless either of the

Contracting Parties give notice in writing, to the other,

six month prior to the date of expiry the Agreement,

its intention to denounce.

2. Wypowiedzenie umowy nie b´dzie mia∏o wp∏ywu na przedsi´wzi´cia podj´te i realizowane zgodnie

z umowà w czasie jej obowiàzywania, a˝ do czasu ich

zakoƒczenia.

2. Termination of this Agreement does not curtail

its pertinence to rights and responsibilities that were

agreed upon and arose on its basis during its period of

validity.

Umow´ niniejszà sporzàdzono w Wilnie dnia

14 wrzeÊnia 1997 r. w dwóch egzemplarzach, ka˝dy

w j´zykach polskim, litewskim i angielskim, przy czym

wszystkie teksty sà jednakowo autentyczne; w razie

rozbie˝noÊci przy ich interpretacji tekst angielski uwa˝any b´dzie za rozstrzygajàcy.

Done in duplicate at Vilnius, this 14th day of

September 1997 in the Polish, Lithuanian and English

languages, all texts being equally authentic. In case of

any divergency of interpretation, the English text shall

prevail.
