DISPUTE SETTLEMENT — SAPARD

1. Any dispute between the Contracting Parties

concerning this Agreement which is not settled

between the Contracting Parties shall be decided

following arbitration by an Arbitration Tribunal in

accordance with points 2 to 7 of this Section.

4. If either Contracting Party fails to appoint its

arbitrator within a period of three months of the

receipt of the request for arbitration, that arbitrator

shall be appointed by the President of the Court of

Justice of the European Communities.

2. Each contracting party has the right to invoke

the Dispute Settlement procedure. Each party shall

nominate its arbitrator within three months of the

initiation of the procedure.

5. Should any arbitrator resign, die or become

unable to act, another arbitrator shall be appointed

in accordance with points 2, 3 and 4 and shall have

all the powers and duties of the original arbitrator.

3. The Arbitration Tribunal constituted for each

individual case shall consist of three arbitrators

appointed as follows

6. The Arbitration Tribunal shall take account of

the relevant case law of the European Court of

Justice.

7. All decisions shall be made by majority vote of

the Arbitration Tribunal. The arbitration procedure

shall be fixed by the Tribunal. Its decisions shall be

binding on both Contracting Parties. Each

Contracting Party shall bear the costs of its own

arbitrator and its representations in the arbitration

proceedings; the remaining costs shall be borne in

equal parts by the Contracting Parties.

z dnia 14 kwietnia 2000 r. o umowach mi´dzynarodowych (Dz. U. Nr 39, poz. 443) Rada Ministrów Rzeczypospolitej Polskiej udzieli∏a w dniu 20 grudnia 2000 r.

zgody na zwiàzanie Rzeczypospolitej Polskiej „Wieloletnià Umowà Finansowà dotyczàcà Specjalnego

Programu Akcesyjnego na Rzecz Rozwoju Rolnictwa

i Obszarów Wiejskich (SAPARD)” poprzez jej podpi-

sanie. Umowa zosta∏a podpisana w Brukseli, dnia

25 stycznia 2001 r.

Zgodnie z art. 9 umowa wesz∏a w ˝ycie w dniu

18 maja 2001 r.

Na podstawie art. 40 ust. 1, art. 47 ust. 1 i art. 74

ust. 2 i 3 ustawy z dnia 12 kwietnia 2001 r. — Ordynacja wyborcza do Sejmu Rzeczypospolitej Polskiej

i do Senatu Rzeczypospolitej Polskiej (Dz. U. Nr 46,

poz. 499 i Nr 74, poz. 786) Paƒstwowa Komisja Wyborcza uchwala, co nast´puje

oraz zadaƒ pe∏nomocników do sprawdzenia zgodnoÊci arytmetycznej wyników g∏osowania w obwodzie

w wyborach do Sejmu i Senatu.
