(ratyfikowany zgodnie z ustawą z dnia 18 lutego 1932 r.).
Statutory Text (5 Articles)
§ 1. Osoby wymienione wart. 10 punkt 1 prawa lotniczego, które czy to w kraju, czy też na obszarze państwa obcego, n ab ędą tyluł własności statku powietrznego obowiązane są dla uzyskania prawa dokonywania lotów na danym statku powietrznym, wystąpić o wpisanie go do rejestru p aństwowe
go statków powietrznych.
§ 2. Statek powietrzny może być wpisany do
rejestru państwowego dopiero wt edy, gdy zostanie
stwierdzona jego zdolność do lotu (§§ 18 lub 22)
oraz, że nie jest on wpisany do rejestru zagraniczne~o.

§ 3. Rejestr państwowy statków powietrznych
prowadzi Ministerstwo Komunikacji według wzoru
Nr. 1, załączonego do n.inie,jszego rozporządzenia.
Sposób prowadzenia rejestru państwowego
statków powietrznych ustali instrukcja wydana przez
Ministra Komunikacji.
§ 4. Ministerstwo Komunikacji dokonywa rejestracji statku powietrznego na podstawie nadesła
nego przez właściciela statku powietrznego pisemnego zgłoszenia, sporządzonego według wzoru Nr. 2"
dołączonego do niniejszego rozporządzenia.
Do z'głoszenia powinny być dołączone następu
jące dokumenty
1) jeden z dowodów stwierdzających
a) obywatelstwo polskie, jeżeli właścicielem
statku powietrznego jest osoba fizyczna
(art. 10 punkt 1 lit. b prawa lotniczego),
b} charakter p'rawno - publiczny, jeżeli właści
cielem statku powietrznego jest krajowa psoba prawna prawa publicznego (art. 10
punkt 1 lit. c prawa lotniczego),
c) obywatelstwo polskie prezesa i co najmniej
2/3 członków zarządu, jeżeli właścicielem
statku powietrznego jest krajowa osoba
prawna prawa prywatnego (art. 10 punkt 1
lit. d prawa lotniczego),
d) obywatelstwo polskie wszystkich spólników,
jeżeli właścicielem statku jest spółka jawna
(art. 10 punkt 1 lit. e prawa lotniczego).
Osoby prawa publicznego, nie będące instytucjami państwowemi lub samorządu terytorjalnego,
czynią zadość wymaganiu wymienionemu w punkcie b) ustępu poprzedniego przez powołanie się na
odnośny przepis prawny.
Ponadto w wypadkach wyszczególnionych pod
b), c) i d) ustępu drugiego, powinien być dołączony
również dowód, stwierdzający, że osoby fizyczne,
działające przy rejestrowaniu statku w imieniu danej
osoby prawnej lub spółki jawnej, są należycie upoważnione do tego działania (wyciąg z rejestru handlowego lub statiltu lub też odpowiednie upoważnie
nie i t. p.),

MINISTRA KOMUNIKACJI
z dnia 5 kwietnia 1932 r.
wydane w porozumieniu z Ministrami: Spraw Wojskowych, Spraw Wewnętrznych, a co do §§ 1 - 41
oraz §§ 50 - 65 również w porozumieniu z Ministrem Przemysłu i Handlu o rejestrze państwowym
statków powietrznych, o sposobie ich rejestracji,
0_ badaniu zdolności do lotu, oraz o trybie wydawania dokumentów i ksiąg pokładowych tych statków,
O systemie znaczenia statków powietrznych i umieszczania znaków na nich oraz o zakładaniu i prowadzeniu ksiąg pokładowych.
Na podstawie art. 8 p. a) i c}, art. 12, art. 15
ust. 2, art. 16, art. 27 ust. 2 i art. 36 ust. 2 rozporzą
dzenia Prezydenta Rzeczypospolitej z dn. 14 marca
1928 r. o prawi'e lotniczem (Dz. U. R. P. Nr. 31,
