1 Notawisseling houdende een verdrag tussen het Koninkrijk der Nederlanden en het Internationaal Joegoslavië Tribunaal (ICTY) inzake de positie van ICTY-stagiairs in Nederland (icty)

For the purpose of this Agreement, the following definition of an intern shall apply: A graduate or postgraduate student who has been accepted by the UN-ICTY into the internship programme of the UN-ICTY and who, on that basis, performs certain tasks for the UN-ICTY without receiving emoluments from the UN-ICTY by reason of his work with the UN-ICTY and who has signed the declaration “Acceptance and Undertaking”, a copy of which is attached as Annex, provided by the UN-ICTY. An intern shall not be considered in any respect to fall under one of the categories of persons as described in Article I of the Headquarters Agreement.

Voor de toepassing van dit verdrag geldt de volgende begripsomschrijving van een stagiair: Een student die een universitaire of postdoctorale opleiding volgt en door het UN-ICTY is toegelaten tot het stageprogramma van het UN-ICTY en die, op basis daarvan, bepaalde taken voor het UN-ICTY verricht zonder hiervoor emolumenten van het UN-ICTY te ontvangen uit hoofde van zijn werkzaamheden bij het UN-ICTY en die de door het UN-ICTY verstrekte verklaring „Aanvaarding en Belofte” heeft ondertekend, waarvan een kopie als bijlage hierbij gaat. Een stagiair wordt in geen enkel opzicht beschouwd als behorende tot één van de categorieën van personen als omschreven in artikel I van het Zetelverdrag.

For the purpose of their internship with the UN-ICTY the Ministry of Foreign Affairs shall register the intern in the Netherlands for a period of maximum one (1) year, which in exceptional circumstances may be extended once by a maximum period of one (1) year under the following conditions

that the intern entered into the Netherlands in accordance with the applicable immigration procedures;

that he is not allowed to work in the Netherlands during his internship other than as an intern at the UN-ICTY;

that he will leave the Netherlands within 14 days after termination of his internship with the UN-ICTY, the duration of which shall not exceed one (1) year, which in exceptional circumstances may be extended once by a maximum period of one (1) year;

that the intern shall have sufficient medical insurance as well as sufficient financial means for repatriation and that he shall not be a charge to the Netherlands public means.

The intern is obliged to demonstrate to the satisfaction of the UN-ICTY the fulfillment of these conditions and shall sign the declaration to this effect referred to in Article 1 above. The UN-ICTY shall not be held liable should it turn out that, while in the Netherlands during the duration of the internship, the intern does not fulfil the required conditions.

Ten behoeve van hun stage bij het UN-ICTY registreert het ministerie van Buitenlandse Zaken de stagiair in Nederland voor een tijdvak van ten hoogste een (1) jaar, dat in uitzonderlijke gevallen eenmaal kan worden verlengd met een tijdvak van ten hoogste een (1) jaar, onder de volgende voorwaarden

dat de stagiair Nederland is binnengekomen in overeenstemming met de geldende immigratieprocedures;

dat het hem niet is toegestaan gedurende zijn stage in Nederland werkzaamheden te verrichten anders dan als stagiair bij het UN-ICTY;

dat hij Nederland zal verlaten binnen 14 dagen na beëindiging van zijn stage bij het UN-ICTY, waarvan de duur ten hoogste een (1) jaar, dat in uitzonderlijke gevallen eenmaal kan worden verlengd met een tijdvak van ten hoogste een (1) jaar bedraagt;

dat de stagiair een toereikende ziektekostenverzekering heeft alsmede voldoende financiële middelen voor terugkeer naar zijn land en dat hij niet ten laste komt van de Nederlandse openbare middelen.

De stagiair is verplicht ten genoegen van het UN-ICTY aan te tonen dat hij aan deze voorwaarden voldoet en ondertekent hiertoe de in artikel 1 bedoelde verklaring. Het UN-ICTY is niet aansprakelijk wanneer mocht blijken dat de stagiair, tijdens zijn verblijf in Nederland gedurende de stageperiode, niet aan de gestelde voorwaarden voldoet.

The intern does not enjoy any privileges or immunities in the Netherlands, except

immunity from legal process in respect of words spoken or written and all acts performed by them in their official capacity for the UN-ICTY, which immunity shall continue to be accorded even after termination of the internship with the UN-ICTY for activities carried out on its behalf;

inviolability of all papers, documents in whatever form and materials relating to the performance of their functions for the UN-ICTY.

The privileges and immunities are granted in the interest of the Tribunal and not for the personal benefit of the individuals themselves. The President of the Tribunal has the right and duty to waive these privileges and immunities in any particular case where they would impede the course of justice and can be waived without prejudice to the purpose for which they were accorded.

De stagiair geniet in Nederland geen voorrechten of immuniteiten, behalve

immuniteit van rechtsvervolging met betrekking tot alle door hen in hun officiële hoedanigheid voor het UN-ICTY gesproken of geschreven woorden en verrichte handelingen; deze immuniteit blijft ook gelden na beëindiging van de stage bij het UN-ICTY voor namens het UN-ICTY uitgevoerde activiteiten;

onschendbaarheid van alle stukken en documenten in welke vorm dan ook en materiaal dat betrekking heeft op de uitoefening van hun functie bij het UN-ICTY.

De voorrechten en immuniteiten worden verleend in het belang van het Tribunaal en niet voor het persoonlijk nut van de personen zelf. De President van het Tribunaal is bevoegd en heeft de plicht deze voorrechten en immuniteiten op te schorten in elk geval waarin zij de loop van het recht in de weg staan en kunnen onverminderd het doel waarvoor zij zijn verleend worden opgeschort.

The UN-ICTY shall notify the Ministry of Foreign Affairs within eight (8) days after first arrival of the intern in the Netherlands and request an identity card for the intern.

Het UN-ICTY stelt het ministerie van Buitenlandse Zaken binnen acht (8) dagen na de eerste aankomst van de stagiair in Nederland hiervan in kennis en verzoekt om een identiteitskaart voor de stagiair.

Upon request of the UN-ICTY the Ministry of Foreign Affairs shall issue the intern an identity card bearing the code ZF.

Op verzoek van het UN-ICTY geeft het ministerie van Buitenlandse Zaken aan de stagiair een identiteitskaart af voorzien van de code ZF.

The UN-ICTY shall, within eight (8) days, notify the Ministry of Foreign Affairs of the final departure of the intern from the Netherlands and at the same time return the identity card of the intern.

Het UN-ICTY stelt het ministerie van Buitenlandse Zaken binnen acht (8) dagen in kennis van het definitieve vertrek van de stagiair uit Nederland en retourneert tegelijkertijd de identiteitskaart van de stagiair.

This Agreement may be amended by mutual consent at any time at the request of either of the Parties.

Dit verdrag kan op verzoek van een van beide Partijen in onderlinge overeenstemming te allen tijde worden gewijzigd.

Any dispute between the Parties concerning the interpretation or application of this Agreement, which cannot be settled amicably, shall be settled by way of the procedure set out in Article XXVIII, paragraph 2, of the Headquarters Agreement.

Geschillen tussen de Partijen inzake de uitlegging of toepassing van dit verdrag die niet in der minne kunnen worden geregeld, worden geregeld door middel van de procedure vervat in artikel XXVIII, tweede lid, van het Zetelverdrag.

This Agreement is concluded for an indefinite period of time. At any time, either Party may terminate the Agreement giving three (3) months advance notice in writing to the other Party.

Dit verdrag wordt gesloten voor onbepaalde tijd. Elk van beide Partijen kan dit verdrag te allen tijde beëindigen door middel van een schriftelijke kennisgeving aan de andere Partij met een termijn van drie (3) maanden.
