NOMINATION OF COMPETENT AUTHORITY

ORDER

LEGAL NOTICES 334 of 2001, 107 and 172 of 2002, and 211 of 2012,

consolidated, as amended by Act XXV of 2015.

The title of this Order is the Nomination of Competent

Authority Order.

The Environment and Resources Authority is hereby

nominated as the competent authority for the purposes of the

Environment Protection Act, to carry out the functions of the

competent authority under the said Act

Sohowever that the Minister responsible for the protection

of the environment may by regulations issued under the said Act

establish that another person or body shall be responsible for the

performance of such regulations.

The Regulator for Energy and Water Services is hereby

established as the competent authority with respect to indirect

discharges referred to in the following regulations made under the

Environment Protection Act

(a) the Pollution caused by Certain Dangerous Substances

discharged into the Aquatic Environment Regulations;

(b) the Limit Values and Quality Objectives for Hexachlo-

rocyclohexane Discharges Regulations;

(c) the Limit Values and Quality Objectives for Mercury

Discharges by Sectors other than the Chlor-Alkali

Electrolysis Industry Regulations;

(d) the Limit Values and Quality Objectives for Mercury

Discharges by the Chlor-Alkali Electrolysis Industry

Regulations;

(e) the Limit Values and Quality Objectives for Cadmium

Discharges Regulations; and

(f)

the Limit Values and Quality Objectives for

Discharges of Certain Dangerous Substances into the

Aquatic Environment Regulations.

The Regulator for Energy and Water Services in

consultation with the Ministry responsible for Health is to carry out

the functions of the competent authority under the Quality required

of Surface Water Intended for the Abstraction of Drinking Water

Regulations.

of the competent authority under the European Union Greenhouse
