MACHINERY REGULATIONS

(1) The title of these regulations is the Measures Against
the Emission of Gaseous and Particulate Pollutants from Internal
Combustion Engines to be Installed in Non-Road Mobile
Machinery Regulations.

These regulations implement the requirements set by
Regulation (EU) 2016/1628 of the European Parliament and of the
Council of 14 September 2016 on requirements relating to gaseous
and particulate pollutant emission limits and type-approval for
internal combustion engines for non-road mobile machinery.
In these regulations, unless the context otherwise requires
"the Act" means the Malta Competition and Consumer Affairs
Authority Act;
"approval authority" means the Malta Competition and
Consumer Affairs Authority established by article 3 of the Malta
Competition and Consumer Affairs Authority Act.
The Technical Regulations Division of the Malta
Competition and Consumer Affairs Authority is the approval
authority and the market surveillance authority within the meaning
of Regulation (EU) 2016/1628.
The penalties applicable to any infringement related to
these regulations shall be those provided for in Part IV of the
Product Safety Act.
(1) Without prejudice to the transitional provisions
stipulated in Article 58(1) to (4) of Regulation 2016/1628, the
Measures Against the Emission of Gaseous and Particulate
Pollutants from Internal Combustion Engines to be Installed in
Non-Road Mobile Machinery Regulations, 2013, are hereby
revoked.
(2) Any references to the repealed regulations mentioned in
sub-regulation (1) shall be construed as references to these
regulations.
