(IMPLEMENTING) REGULATIONS

The title of these regulations is the EU Fertilising

Products (Implementing) Regulations.

These regulations implement the provisions of

Regulation (EU) 2019/1009 of the European Parliament and of the

Council of 5 June 2019 laying down rules on the making available on

the market of EU fertilising products and amending Regulations (EC)

No 1069/2009 and (EC) No 1107/2009 and repealing Regulation (EC)

No 2003/2003.

In these regulations, unless the context otherwise

requires

"Regulation (EU) 2019/1009" means Regulation (EU)

2019/1009 of the European Parliament and of the Council of 5

June 2019 laying down rules on the making available on the

market of EU fertilising products and amending Regulations

(EC) No 1069/2009 and (EC) No 1107/2009 and repealing

Regulation (EC) No 2003/2003.

For the purpose of Regulation (EU) 2019/1009, the

Technical Regulations Division established by article 19 of the Malta

Competition and Consumer Affairs Authority Act shall be the

notifying authority responsible for setting up and carrying out the

necessary procedures for the assessment and notification of

conformity assessment bodies and the monitoring of notified bodies,

including compliance with Article 26 Regulation (EU) 2019/1009.

Any information which shall be provided in accordance

with the provisions of Regulation (EU) 2019/1009 shall be in at least

the Maltese or English language

Provided that any information which shall be provided in

accordance with Articles 6(6), 6(7), 8(3), 8(4) and 9(2) shall be in at

least the Maltese, English, or Italian language.

The procedures for the assessment, notification and

monitoring of conformity assessment bodies shall be those prescribed

in the Method for Designating Conformity Assessment Bodies

Regulations.
