ELECTRONIC COMMUNICATIONS SERVICE

(MODIFICATION OF RADIO TRACKING SYSTEM

AND SERVICES LICENCE) REGULATIONS

LEGAL NOTICE 48 of 2001.

The title of these regulations is the Electronic

Communications Service (Modification of Radio Tracking System

and Services Licence) Regulations.

In these regulations -

"Act" means the Electronic Communications (Regulation) Act,

and includes the First Schedule thereto;

"the Instrument of Modification" means the Instrument of

Modification of the original licence issued by the Minister under

article 46 of the Act on the 4th March, 2001 in respect of the said

original licence, which instrument was laid on the Table of the

House on the 5th March, 2001;

"the original licence" means the Licence entitled a "Licence to

establish and operate a real time fixed and mobile data location and

m on i to r in g s ys t e m " i s s u e d on t he 5 t h A ug us t, 1 99 8 b y t h e

Electronic Communications Regulator in favour of the company

Datatrak Systems Limited;

"the modified licence" means the original licence as modified by

the Intrument of Modification.

The terms and conditions of the original licence shall, as

from the 4th March, 2001 and for the purpose of putting into effect

the provisions of the Act and of implementing the liberalisation of

the Maltese electronic communications market in accordance with

the Act and of implementing a new commercial and regulatory

framework as has been deemed appropriate for the purpose of

implementing the provisions of the Act, be modified to the terms

and conditions included in the modified licence and in accordance

therewith.

These regulations shall complement the Instrument of

Modification and nothing in these regulations shall be interpreted

as prejudicing the force, effect and validity of the Instrument of

Modification.
