In these regulations unless the context otherwise requires -

"Act" means the Local Government Act;

"authorised bag" means a bag authorised by the Department

designed as shown in Schedule B and supplied by the Council,

which is to be tied to the horse and to the karrozzin so as to collect

and keep the horse droppings;

"closed skip" means a closed recipient, be it on wheels or not,

metal or otherwise, provided by the Council in the locality

normally used by the karrozzin, and such skip shall be marked to be

used specifically for the disposal of horse solid discharge, and shall

be placed in a site as may be authorised by the Council;

"Council" means Local Council as defined in the Act;

"Department" means the Department for Local Councils;

"karrozzin" means a horse drawn cab licensed for the conveyance

of persons and pulled by a horse;

"locality" shall have the same meaning as assigned to it in the

Act;

"Minister" means the Minister responsible for Local

Government;

"street" includes any road, alley, square, bridge, quay or other

place of public passage or access.

(GENERAL APPLICATION)

(1) Without prejudice to any other licence required for the

use of a karrozzin on the road, a person shall apply to the Council

of the locality where the karrozzin normally is in use to be provided

with such authorised bag for a fee of twenty three euro twenty-nine

cents (€23.29).

(2) The design, the measurements, the colour and the material

used in the production of the authorised bag shall be those

indicated in Schedule B.

(3) The authorised bag shall at all times be tied to the horse

and to the karrozzin so as to avoid horse droppings from falling

onto to the road.

(4) The application for the authorised bag shall be submitted

on the form prescribed in Schedule A and the authorised bag shall

be provided by the Council after the application has been

submitted.

Any person who has a karozzin under his control in any

street shall at all times ensure that the authorised bag is in good

condition, and also is securely tied to the horse and to the karozzin

so as to avoid at all times solid discharge on the street.

The solid waste collected in the authorised bag shall be

placed in a plastic bag and disposed of by the person who has the

karozzin under his control, in a closed skip provided for this

purpose by the Council where normally the karozzin is in use.

Any person who is in breach of any of the provisions of

these regulations shall be guilty of a contravention and shall be

liable, if found guilty, unless a higher penalty is applicable under

any other law

(a) for the first contravention, to a fine (ammenda) of

twenty-three euro and twenty-nine cents (23.29);

(b) for the second or subsequent contravention, to a fine

(ammenda) of forty-six euro and fifty-nine cents

(46.59).
