LOCAL GOVERNMENT (PROCUREMENT)

REGULATIONS

LEGAL NOTICE 266 of 2017, as amended by Legal Notice 90 of

2018.

The title of these regulations is the Local Government

(Procurement) Regulations.

In these regulations, unless the context otherwise

requires

"the Act" means the Local Government Act;

"Director" has the same meaning as assigned to it in the Act;

"Procurement Guidelines" means the Procurement Guidelines

issued by the Director in terms of article 80 of the Act, to be followed

by the Local Councils in the execution of their functions and

responsibilities under the Act and in accordance with these

regulations;

Save as otherwise provided in the Procurement

Guidelines issued by the Director, as approved by the Minister, the

Public Procurement Regulations shall apply to Local Councils.

The Appeals Board as established in the Local Councils

(Tendering) Regulations, shall hear and decide those appeals which

were lodged and presented before it, which appeals were lodged and

presented until the 1st January, 2018 and which were not decided

until the aforementioned date.
