The title of these Bye-Laws is the Beverages in Glass

Containers and Consumption of Alcohol in Public Places (San

Ġiljan Local Council) Bye-Laws.

1. THE CONSUMPTION OF BEVERAGES

IN GLASS CONTAINERS OUTDOORS IS PROHIBITED BY LAW

2. THE CONSUMPTION OF ALCOHOL IN THE STREETS

IS PROHIBITED BY LAW

3. THE CARRYING OF ALCOHOL IN THE STREETS OTHER THAN IN

SEALED UNOPENED CONTAINERS IS PROHIBITED BY LAW

In these Bye-Laws unless the context otherwise requires

2019. "the Act" means the Local Government Act;

"Council" means the San Ġiljan Local Council;

" d e s i g n a t e d a r e a s " m e a n s th o s e a r e a s d e s i g n a t e d b y t h e

competent authorities for the placement of tables and chairs

exclusively for the consumption of food and beverages;

"glass container" includes glass bottles, glasses, and, or any

other glass container intended for the serving of any beverages;

"locality" means the locality of San Ġiljan as delineated in the

"public place" means all the streets within the San Ġiljan locality;

"streets" means all the streets within the San Ġiljan locality.

No person is permitted to loiter in any public place holding

or having on his person any glass container.

No person is permitted to carry alcohol in the public place

other than in a sealed unopened container.

No person is permitted to consume alcohol in public places

other than in the designated areas.

Any commercial establishment situated within any street or

public place in the locality selling beverages, shall -

(a) affix a notice in Maltese as well as in English as shown

in Schedule A, which notice shall be placed in a

2019. conspicuous place and be easily legible by the patrons

of such commercial establishment; and

(b) provide containers made of a material other than glass

if such beverage is to be consumed in any public place.

Any person who is in breach of any of the provisions of

these Bye-Laws shall, on conviction, be liable to a fine (ammenda)

of sixty- five euro (€65.00) for such contravention, and to a further

fine (ammenda) of ten euro (€10.00) for every day during which

any of the provisions of these Bye-Laws is breached.
