CONTINUATION OF TENANCIES (MEANS TESTING

IN RESPECT OF TENANCIES ORIGINATING UNDER

THE HOUSING (DECONTROL) ORDINANCE,

REGULATIONS

These regulations may be cited as the Continuation of

Tenancies (Means Testing in respect of Tenancies originating under

the Housing (Decontrol) Ordinance, Regulations.

The purpose of these regulations is to make specific

provision in respect of the application mutatis mutandis of the

Continuation of Tenancies (Means Testing) Regulations, hereinafter

in these regulations referred to as "the applicable regulations". to

tenancies and claims to tenancies regulated by article 12B of the

Housing (Decontrol) Ordinance.

Regulation 2 of the applicable regulations shall

also apply to tenancies and claims to tenancies made under article

12B of the Housing (Decontrol) Ordinance.

(2) Regulation 3 of the applicable regulations shall apply in

such manner that in the case of tenancies or claims to tenancies under

article 12B of the Housing (Decontrol) Ordinance the means test shall

be made in respect of the period as provided in article 12B of the said

Ordinance.

(3) (a)

Regulation 4 of the applicable regulations shall

apply to tenancies and claims to tenancies under article 12B of the

Housing (Decontrol) Ordinance and the filing of the claim in respect

of such tenancies or claims to tenancies shall be made in accordance

with the provisions of the said article 12B;

(b)

the provision in sub-regulation (3) of

regulation 4 of the applicable regulations to the effect that a means

test shall be carried out only once shall be applied subject to the

provisions of article 12B of the Housing (Decontrol) Ordinance apart

from any other provisions to which it is already subject.

All provisions of the applicable regulations shall apply

mutatis mutandis to tenancies and claims to tenancies under article

12B of the Housing (Decontrol) Ordinance as provided in the said

article.
