IMPORTATION CONTROL REGULATIONS

The title of these regulations is the Importation Control

Regulations.

"importation" means the bringing of goods into Malta from any

other country, by whatever means the carriage is effected;

"Minister" means the Minister responsible for trade and includes,

to the extent of the authority given, any person authorized by the

Minister in that behalf for any purpose of these regulations.

(a) transfer into Malta any goods from any Member State

of the European Union, which are listed in the First

Schedule;

(b) import any goods, originating in any country outside

the European Union, which are listed in the Second

Schedule;

(c) import any goods listed in the Third or Fourth

Schedules, originating in the countries indicated by the

country codes appearing in the fourth column of the

respective schedules.

(2) For the purposes of subregulation (1), the country codes

(1) An authorization or import licence granted by the

Minister in pursuance of these regulations may be

(a) limited so as to expire on a specified date unless

renewed;

(b) subject to or without conditions;

(c) annulled, suspended, modified or revoked by the

Minister.

(2) Nothing in these regulations shall be taken to prohibit the

importation of any goods under the authority of an authorization or

licence granted by the Minister, provided that all conditions

attaching to the authorization or licence are complied with.

IMPORTATION CONTROL

Substituted by

(1) Without prejudice to the provisions of these

regulations, no person may import any goods originating from any

country, if such importation is not in conformity with a common

position or joint action adopted by the Council of the European

Union, or a binding resolution of the Security Council of the United

Nations or a decision of the Organisation for the Security and Co-

operation in Europe.

(2) Notwithstanding the provisions of these regulations, the

importation of any goods manufactured, duplicated or otherwise

reproduced or copied in violation of the rights of copyright enjoyed

by any person and protected by Maltese law is hereby prohibited

and no authorization or licence shall be granted for such

importation.

Applications for the grant of authorizations or licences for

the importation of goods for the purposes of these regulations shall

be made in such form and contain such particulars as the Minister

may, from time to time, determine.

An authorization or licence issued under these regulations

shall cease to have effect and any goods purported to have been

imported thereunder shall be deemed to have been imported

without an authorization or licence -

(a) if the goods to which the authorization or licence

relates are not shipped within such date as may be

specified to that effect in the authorization or licence,

or, if no such date has been specified, within eight

months from the date of the issue of the authorization

or licence; or

(b) if the goods originate in or are consigned from a

country other than that shown on the authorization or

licence; or

(c) if the authorization or licence is used by a person or

firm other than the one shown on the authorization or

licence; or

(d) if the quantity of the goods imported exceeds that

shown on the authorization or licence.

Any person who contravenes or fails to comply with these

regulations shall be guilty of an offence and shall, on conviction, be

liable -

(a) to a fine (multa) of not less than two hundred and

thirty-two euros and ninety-four cents (232.94) but not

exceeding one thousand and one hundred and sixty-

four euros and sixty-nine cents (1,164.69) or to

imprisonment for a term not exceeding three months or

to both such fine and such imprisonment, when the

value of the goods which have been imported, or in

respect of the importation of which an attempt or a

preparatory act has been made, does not exceed one

thousand and one hundred and sixty-four euros and

sixty-nine cents (1,164.69); or

(b) to a fine (multa) of not less than four hundred and

sixty-five euros and eighty-seven cents (465.87) but

not exceeding two thousand and three hundred and

twenty-nine euros and thirty-seven cents (2,329.37) or

to imprisonment for a term not exceeding six months

or to both such fine and such imprisonment, when the

value of the goods which have been imported, or in

respect of the importation of which an attempt or a

preparatory act has been made, exceeds one thousand

and one hundred and sixty-four euros and sixty-nine

cents (1,164.69),

and in all cases the Court shall moreover order the forfeiture of the

goods to which the offence relates, even though the owner thereof

may not be a party to the proceedings.

If, for the purposes of obtaining an authorization or licence

under these regulations, any person makes any statement or

furnishes any document or information which to his knowledge is

false in a material particular or recklessly makes any statement

which is false in material particular, he shall be guilty of an offence

and shall be liable, on conviction, to a fine (multa) not exceeding

one thousand and one hundred and sixty-four euros and sixty-nine

cents (1,164.69) or to imprisonment for a term not exceeding six

months, or to both such fine and such imprisonment; and any

authorization or licence which may have been granted in

connection with the application for which the false statement was

made or the false document or information was furnished shall be

void as from the time when the authorization or licence was

granted.
