MEDICAL AND KINDRED PROFESSIONS ORDINANCE

(CAP. 31)

Drugs (Control) (Amendment) Regulations, 2026

IN EXERCISE of the powers conferred by article 40A of the

Medical and Kindred Professions Ordinance, the Minister responsible

for public health, after consulting the Council of Health has made the

following regulations:-

(1) The title of these regulations is the Drugs (Control) Citation and

(Amendment) Regulations, 2026 and these regulations shall be read scope.

and construed as one with the Drugs (Control) Regulations, hereinafter S.L. 31.18.

(2) The scope of these regulations is to transpose Commission

Delegated Directive (EU) 2025/2062 of 14 October 2025 amending the

Annex to Council Framework Decision 2004/757/JHA as regards the

inclusion of new psychoactive substances in the definition of drug.

(a) immediately after the item "4F-MDMB-BINACA (or

4F-MDMB-BUTINACA) methyl 2-{[1-(4-fluorobutyl)-1H-

indazole-3-carbonyl]amino}-3,3-dimethylbutanoate"

thereof

there shall be added the following new item

"4-BMC,

4-bromomethcathinone

1-(4-Bromophenyl)-2-

(methylamino)propan-1-one";

(b) immediately after the item "N-ethylhexedrone (or

NEH, Hexen, Ethyl-Hex, Ethyl-hexedrone) 2-(ethylamino)-1-

phenylhexan-1-one" there shall be added the following new

item

"NEP,

N-Ethylnorpentedrone,

2-(Ethylamino)-1-phenylpentan-

1-one";

(c) immediately after the item "EUTYLONE 1-(1,3-

benzodioxol-5-yl)-2-(ethylamino)butan-1-one" there shall be

added the following new item

"2-MMC,

2-methylmethcathinone,

2-(Methylamino)-1-(2-

methylphenyl)propan-1-one".
