Feed-in Tariffs Scheme (Electricity Generated from Solar

Photovoltaic Installations) (Amendment) Regulations, 2025

IN EXERCISE of the powers conferred by article 37 of the

Regulator for Energy and Water Services Act, the Minister responsible

for energy and water services, after consultation with the Regulator for

Energy and Water Services, has made the following regulations:-

(1) The title of these regulations is the Feed-in Tariffs

commencement.

Scheme (Electricity Generated from Solar Photovoltaic Installations)

(Amendment) Regulations, 2025 and these regulations shall be read

and construed as one with the Feed-in Tariffs Scheme (Electricity

Generated from Solar Photovoltaic Installations) Regulations,

hereinafter referred to as the "principal regulations".

(2) These regulations shall be deemed to have come into force

on the 1st January 2025.

In sub-regulation (2) of regulation 2 of the principal

regulations the definition "start of works" shall be deleted.

The First Schedule to the principal regulations shall be

amended as follows

(a) item 3 thereof shall be substituted by the following

new item

"3. The submission date of a request to participate

in the FIT scheme shall be considered in the determination

of the applicable FIT scheme and approval of the FIT under

such scheme by the Regulator.";

(b)

item 8 thereof shall be deleted; and

(c)

item 9 thereof shall be substituted by the following

new item

"9. The applicant for a feed-in tariff shall

submit an application in such form and manner as

required by the Regulator, and which shall contain, or

be accompanied by, such information and documents as

may also be required by the Regulator.

The application for the feed-in tariff shall contain

at least the following information

(a) applicant’s name and size of the

undertaking, where applicable;

(b) location of the project;

(c) list of project costs;

(d) kW DC rating of the solar photovoltaic

installation;

(e) a comprehensive declaration of the de

minimis aid received by the applicant and as

required by the application form.".

The Second Schedule to the principal regulations shall be Amends the

item 4 thereof shall be amended as follows

(i) in paragraph (a) thereof the words "from the 1st

January 2024 until 31st December 2024;" shall be

substituted by the words "from the 1st January 2025 until

31st December 2025;";

(ii) in paragraph (d) thereof the word "Gozo." shall

be substituted by the words "Gozo; and;"; and

(iii) immediately after paragraph (d), as amended,

there shall be added the following new paragraph

"(e) where the installation and, or the

photovoltaic panels and, or its inverter have not

previously been used for the generation of

electricity.".
