Forest Law Enforcement, Governance and Trade Licensing

Scheme (Amendment) Regulations, 2025

IN EXERCISE of the powers conferred by articles 54 and 55 of

the Environment Protection Act, the Minister responsible for the

environment after consultation with the Environment and Resources

Authority, has made the following regulations:-

The title of these regulations is the Forest Law Citation.

Enforcement, Governance and Trade Licensing Scheme (Amendment)

Regulations, 2025 and these regulations shall be read and construed as

one with the Forest Law Enforcement, Governance and Trade S.L. 549.95.

Licensing Scheme Regulations, hereinafter referred to as the "principal

regulations".

Paragraph (a) of regulation 2 of the principal regulations Amends

regulation 2 of

shall be substituted by the following new paragraph

"(a) Council Regulation (EC) No 2173/2005 of 20

December 2005 on the establishment of a FLEGT licensing

scheme for imports of timber into the European Community as

amended by Regulation (EU) No 657/2014 of the European

Parliament and of the Council of 15 May 2014, Commission

Delegated Regulation (EU) 2016/1387 of 9 June 2016 and

Regulation (EU) 2019/1010 of the European Parliament and of

the Council of 5 June 2019, hereinafter referred to as

"Regulation (EC) No. 2173/2005"; and".

Regulation 3 of the principal regulations shall be amended Amends

regulation 3 of

as follows

the principal

regulations.

(a) the definition "competent authority" thereof shall be

substituted by the following new definition

" "competent authority" means the Environment and

Resources Authority as established by article 6 of the

Environment Protection Act;";

(b)

the definition "Director" thereof shall be deleted;

(c)

the definition "timber" thereof shall be substituted by

the following new definition

" "timber" means timber products as defined in article

2 of Regulation (EC) No 2173/2005.".

Sub-regulation (1) of regulation 4 of the principal

regulations shall be substituted by the following new sub-regulation

"(1) The competent authority shall be responsible for the

implementation of these regulations, Regulation (EC) No. 2173/

2005 and the Implementing Regulation.".

In sub-regulation (1) of regulation 6 of the principal

regulations the words "The Director may, for the purposes of these

regulations, appoint officers who will have such functions as the

Director may deem necessary for the enforcement and implementation

of any provision of these regulations, Regulation (EC) No. 2173/2005

and the Implementing Regulation, and shall have the right to:" shall be

substituted by the words "An officer authorised by the competent

authority shall have the power to, at all reasonable times, for the

purposes of carrying out his functions in accordance with these

regulations and upon production of an identification document:".

In regulation 7 of the principal regulations the words "the

Director may request" shall be substituted by the words "the competent

authority may request".

Regulation 8 of the principal regulations shall be amended

as follows

(a) in paragraph (g) of sub-regulation (1) thereof the

words "by the Director" shall be substituted by the words "by the

competent authority";

(b) in paragraph (a) of sub-regulation (3) thereof the

words "of the Director" shall be substituted by the words "of the

competent authority".
