Regulated Markets and Market Operators (Authorisation

Requirements) (Amendment) Regulations, 2025

IN EXERCISE of the powers conferred by article 49 of the

Financial Markets Act, the Minister responsible for the regulation of

financial services, acting on the advice of the Malta Financial Services

Authority, has made the following regulations

(1) The title of these regulations is the Regulated Citation and

Markets and Market Operators (Authorisation Requirements) scope.

(Amendment) Regulations, 2025 and these regulations shall be read

and construed as one with the Regulated Markets and Market S.L. 345.04.

Operators (Authorisation Requirements) Regulations, hereinafter

referred to as the "principal regulations".

(2) The scope of these regulations is to transpose Article 1(6)

of Directive (EU) 2024/790 of the European Parliament and of the

Council of 28 February 2024 amending Directive 2014/65/EU on

markets in financial instruments.

Paragraph (2) of item 3 of the Schedule to the principal Amends the

Schedule to the

regulations shall be amended as follows

(a) in sub-paragraph (e) thereof the words "under its

systems." shall be substituted by the words "under its systems;";

(b) immediately after sub-paragraph (e) thereof there

shall be added the following new sub-paragraphs

"(f) it has arrangements in place to ensure that it

meets data quality standards pursuant to Article 22b of

MiFIR;

(g) it has at least three (3) materially active

members or users, each having the opportunity to interact

with all the others in respect of price formation.".
