Limitation of Emissions of Certain Atmospheric Pollutants

(Amendment) Regulations, 2025

IN EXERCISE of the powers conferred by articles 54 and 55 of

the Environment Protection Act, the Minister responsible for the

environment, after consultation with the Environment and Resources

Authority, has made the following regulations:-

(1) The title of these regulations is the Limitation of

Emissions of Certain Atmospheric Pollutants (Amendment)

Regulations, 2025 and these regulations shall be read and construed as

one with the Limitation of Emissions of Certain Atmospheric

Pollutants Regulations, hereinafter referred to as the "principal

regulations".

(2) These regulations transpose the provisions of Commission

Delegated Directive (EU) 2024/299 of 27 October 2023 amending

Directive (EU) 2016/2284 of the European Parliament and of the

Council on the methodology for the reporting of projected emissions

of certain atmospheric pollutants.

In Table B of the First Schedule to the principal regulations

the words "Projected emissions by aggregated NFR" shall be

substituted by the words "Projected emissions by NFR source

category".

In item 2 of Part 2 of the Third Schedule to the principal

regulations the words "Projections of emissions shall be estimated and

aggregated to relevant source sectors." shall be substituted by the

words "Projections of emissions shall be estimated and reported by

NFR source category. Where not possible due to lack of sufficiently

detailed data, a justification for reporting at a more aggregated level

shall be included in the Informative Inventory Report.".
