RE-USE OF PUBLIC SECTOR INFORMATION ACT

(CAP. 546)

Organisational Structures for Data Sharing and Re-Use

(Amendment) Regulations, 2025

IN EXERCISE of the powers conferred by article 25 of the Re-

Use of Public Sector Information Act, the Minister responsible for

public sector information has made the following regulations:-

(1) The title of these regulations is the Organisational

Structures for Data Sharing and Re-Use (Amendment) Regulations,

2025 and these regulations shall be read and construed as one with the

Organisational Structures for Data Sharing and Re-Use Regulations,

hereinafter referred to as the "principal regulations".

(2) The scope of these regulations is to further transpose the

provisions of Directive (EU) 2019/1024 of the European Parliament and

of the Council of 20 June 2019 on open data and the re-use of public

sector information (recast) and to introduce further amendments to

reflect the developments taking place within the field of data.

Sub-regulation (2) of regulation 1 of the principal

regulations shall be amended as follows

(a) in paragraph (c) thereof immediately after the words

"Register of Registers" there shall be added the words "published

on the national data portal";

(b) in paragraph (f) thereof the words "Governance

Registers; and" shall be substituted by the words "Governance

Registers;";

(c) in paragraph (g) thereof the words "Governance

Council." shall be substituted by the words "Governance

Council; and"; and

(d) immediately after paragraph (g) thereof, as amended,

there shall be added the following new paragraph

"(h) the implementation of regulatory measures

emanating from Directive (EU) 2019/1024 of the European

Parliament and of the Council of 20 June 2019 on open data

and the re-use of public sector information (recast) and any

related Directives and Regulations.".

Regulation 2 of the principal regulations shall be amended Amends

the definition "Agency" shall be deleted;

(b) immediately after the definition "controller" there

shall be added the following new definition

" "Council" or "the Council" or "the Data Governance

Council" mean the Data Governance Council as established

by Part XI;";

(c) immediately after the definition "dataset" there shall

be added the following new definition

" "Data Classification Scheme" means the Data

Classification Scheme as established in Part VI;";

(d) in the definition "Data Governance Register"

immediately after the words "official register" there shall be added

the words "published on the national data portal";

(e) the definition "open data" shall be substituted by the

following new definition

" "open data" means and refers to a concept that is

generally understood to denote data in an open format that

can be freely used, re-used and shared by anyone for any

purpose;";

(f) immediately after the definition "open data" as

substituted there shall be added the following new definition

"open data policies" means policies which encourage

the wide availability and re-use of public sector

information for private or commercial purposes, with

minimal or no legal, technical or financial constraints;";

and

(g)

in the definition "user" the word "shall" shall be

deleted.

In paragraph (b) of sub-regulation (3) of regulation 13 of Amends

In sub-regulation (1) of regulation 19 of the principal

regulations the words "in the First Schedule" shall be substituted by

the words "on the national data portal".

Regulation 25 of the principal regulations shall be amended

as follows

(a) in sub-regulation (2) thereof immediately after the

words "public administration functions" there shall be added the

words "as well as the focal point for any other data-related

matters as directed by the Minister responsible for public sector

information.";

(b) immediately after sub-regulation (6) thereof there

shall be added the following new sub-regulation

"(6a) The chairperson may appoint a secretary to

serve the Council.".

The First, Second, Third, Fourth and Fifth Schedules to the

principal regulations shall be deleted.
