Credit Institutions (Fees) (Amendment) Regulations, 2025

IN EXERCISE of the powers conferred by article 3 of the

Banking Act, the Minister responsible for the regulation of financial

services, acting on the advice of the Malta Financial Services

Authority, has made the following regulations:-

The title of these regulations is the Credit Institutions Citation.

(Fees) (Amendment) Regulations, 2025 and these regulations shall be

read and construed as one with Credit Institutions (Fees) Regulations, S.L. 371.10.

hereinafter referred to as the "principal regulations".

Sub-regulation (1) of regulation 2 of the principal Amends

regulation 2 of

regulations shall be amended as follows

regulations.

(a) immediately after the definition "the Act" there shall

be added the following new definition

" "branch-level deposits" means deposits of a branch

established in Malta by a European credit institution or a

third-country credit institution, excluding the deposits

which were received from the head office of such branch;";

(b) the definition "deposits" shall be substituted by the

following new definition

" "deposits" means the sum of deposits reported to the

competent authority in the balance sheet statement for

liabilities as at the end of the preceding calendar year;";

(c) immediately after the definition "European regulatory

authority" there shall be added the following new definition

" "institution-level deposits" means deposits at the

highest level of prudential consolidation in Malta;".

The Second Schedule to the principal regulations shall be Amends the

regulations.

(a) the words "of deposits", wherever they occur, shall be

substituted by the words "of institution-level deposits";

(b) the words "of the branch’s deposits", wherever they

occur, shall be substituted by the words "of branch-level

deposits".
