European Union Greenhouse Gas Emissions Trading System for

Stationary Installations (Amendment) Regulations, 2025

IN EXERCISE of the powers conferred by article 27(1) of the

Climate Action Act, the Minister responsible for climate action policy,

in consultation with the Climate Action Authority, has made the

following regulations:-

(1) The title of these regulations is the European Union

Greenhouse Gas Emissions Trading System for Stationary Installations

(Amendment) Regulations, 2025 and these regulations shall be read

and construed as one with the European Union Greenhouse Gas

Emissions Trading System for Stationary Installations Regulations,

hereinafter referred to as the "principal regulations".

(2) These regulations further transpose Directive 2003/87/EC

of the European Parliament and of the Council of 13 October 2003

establishing a scheme for greenhouse gas emission allowance trading

within the Community and amending Council Directive 96/61/EC, as

amended by Directive (EU) 2023/958 of the European Parliament and

of the Council of 10 May 2023 amending Directive 2003/87/EC as

regards aviation’s contribution to the Union’s economy-wide emission

reduction target and the appropriate implementation of a global

market-based measure.

In sub-regulation (2e) of regulation 11 of the principal

regulations the words "from sub-regulation (6)" shall be substituted by

the words "from sub-regulation (2d)".

In sub-regulation (4a) of regulation 19 of the principal

regulations immediately after the words "life of the product" there

shall be added the words ", as determined in accordance with the

relevant decisions and regulations adopted pursuant to Directive 2003/

87/EC.".
