Micro Investment (Amendment) Regulations, 2024

IN EXERCISE of the powers conferred by article 5 of the Malta

Enterprise Act, the Minister responsible for Malta Enterprise with the

concurrence of the Minister for Finance, has made the following

regulations: -

The title of these regulations is the Micro Investment Citation.

(Amendment) Regulations, 2024 and these regulations shall be read

and construed as one with the Micro Investment Regulations, S.L. 463.09.

hereinafter referred to as the "principal regulations".

In regulation 2 of the principal regulations the definition Amends

"single undertaking" shall be substituted by the following new regulation

""single undertaking" shall have the same meaning as

assigned to it in the Commission Regulation (EU) 2023/2831 of

13 December 2023 on the application of Articles 107 and 108 of

the Treaty on the Functioning of the European Union to de

minimis aid;".

Regulation 3 of the principal regulations shall be amended Amends

(a) in sub-regulation (1) thereof the last proviso shall be

substituted by the following new proviso

"Provided further that the total amount of de

minimis aid awarded to a single undertaking before or on

31 st December 2023 may not exceed two hundred thousand

euro (€200,000), or one hundred thousand euro €100,000)

in case of undertakings performing road freight transport

for hire or reward, over any period of three (3) consecutive

fiscal years. The total amount of de minimis aid awarded to

a single undertaking after 31 st December 2023 may not

exceed three hundred thousand euro (€300,000) over any

period of three (3) consecutive years.";

(b) sub-regulation (7) thereof shall be substituted by the

following new sub-regulation

"(7) No assistance in accordance with these

regulations shall be granted by the Corporation on costs

incurred after 31 st December 2024. No aid shall be granted

by the Corporation in accordance with these regulations

after 31st December 2026.".
