Borehole Drilling and Excavation Works within the Saturated

Zone (Amendment) Regulations, 2024

IN EXERCISE of the powers conferred by articles 54 and 55 of

the Environment Protection Act, the Minister responsible for the

Environment, after consultation with the Environment and Resources

Authority, has made the following regulations:-

The title of these regulations is the Borehole Drilling and

Excavation Works within the Saturated Zone (Amendment)

Regulations, 2024 and these regulations shall be read and construed as

one with the Borehole Drilling and Excavation Works within the

Saturated Zone Regulations, hereinafter referred to as the "principal

regulations".

Sub-regulation (2) of regulation 6 of the principal

regulations shall be amended as follows

(a)

in paragraph (d) thereof, the word "and" shall be

deleted;

(b) in the second proviso to paragraph (e) thereof the

words "groundwater source." shall be substituted by the words

"groundwater source; and"; and immediately after there shall be

added the following new paragraph

"(f) any borehole proposed to be constructed by a

public entity for research and development purposes,

within the saturated zone, subject to prior approval by the

Authority.".
