AUTHORITY FOR TRANSPORT IN MALTA ACT

Passenger Transport Services (Amendment) Regulations, 2024

IN EXERCISE of the powers conferred by article 43 of the

Authority for Transport in Malta Act, the Minister responsible for

transport, after consultation with the Authority for Transport in Malta,

has made the following regulations:-

The title of these regulations is the Passenger Transport Citation.

Services (Amendment) Regulations, 2024 and these regulations shall

be read and construed as one with the Passenger Transport Services S.L. 499.56.

Regulations, hereinafter referred to as the "principal regulations".

In regulation 2 of the principal regulations, the definition Amends

"new motor vehicle" shall be substituted by the following new regulation

" "new motor vehicle" means, for the purposes of these

regulations, a motor vehicle which

(a)

has never been registered in any country;

(b) has been registered only once (1) in any other

country provided that

(i) it has not been driven with its own motor

for more than six thousand kilometres (6,000km); and

(ii) it shall be effectively registered as a new

motor vehicle in Malta within three (3) months from

the effective date of the first registration of the new

motor vehicle in the other country;".

Sub-regulation (2) of regulation 28 of the principal Amends

regulation 28 of

regulations shall be amended as follows

regulations.

(a) in the third proviso thereof the words "shall not

apply." shall be substituted by the words "shall not apply:"; and

(b) immediately after the third proviso thereof as

amended, there shall be added the following new proviso

"Provided further that the new motor vehicle

that has been registered in any other country and satisfies

the requirements of these regulations, shall not be

considered as a passenger transport vehicle which is not

new in accordance with this sub-regulation.".

Immediately after regulation 28 of the principal regulations

as amended, there shall be added the following new regulation

" Condition for

A new motor vehicle that has been registered

in

another

country as a new motor vehicle prior to its

registration in Malta, shall be considered as a passenger

transport vehicle which is not new in accordance with

regulation 28, if the operator or a person authorised by the

operator that is the holder of said registration, transfer the

ownership of the vehicle to third persons prior to the lapse

of three (3) years from the date of the registration of the

vehicle in Malta.".
