Trademark (Amendment) Rules, 2024

IN EXERCISE of the powers conferred by article 101 of the

Trademarks Act, the Minister responsible for the protection of

Industrial Property, has made the following rules:-

The title of these rules is the Trademark (Amendment)

Rules, 2024 and these rules shall be read and construed as one with the

Trademark Rules, hereinafter referred to as the "principal rules".

Sub-rule (3) of rule 32 of the principal rules shall be

substituted by the following new sub-rule

"(3) An applicant, owner or other interested person shall

indicate in any communication an address for correspondence as

well as an address for the purposes of service which shall be in

the European Economic area

Provided that where an agent is not appointed and

where an applicant, owner or other interested person has

provided as his address, an address in the European Economic

Area, the Office of the Comptroller shall consider that address to

be the address for correspondence or for the purposes of service

unless that applicant, owner or other interested person expressly

indicates another such address

Provided further that where an agent is appointed, the

address of that agent shall be considered to be the address for

correspondence or for the purposes of service, unless that

applicant, owner or other interested person expressly indicates

another such address.".
