Zootechnical and Genealogical Conditions for the Breeding, Trade

in and Entry into Malta of Purebred Breeding Animals, Hybrid

Breeding Pigs and the Germinal Products thereof (Implementing)

Rules, 2024

IN EXERCISE of the powers conferred by articles 7, 8 and 9, and

34 of the Veterinary Services Act, the Minister responsible for

veterinary services has made the following rules:-

(1) The title of these rules is the Zootechnical and

Genealogical Conditions for the Breeding, Trade in and Entry into

commencement.

Malta of Purebred Breeding Animals, Hybrid Breeding Pigs and the

Germinal Products thereof (Implementing) Rules, 2024.

(2) The scope of these rules is to implement the requirements

of Regulation (EU) 2016/1012 of the European Parliament and of the

Council of 8 June 2016 on zootechnical and genealogical conditions

for the breeding, trade in and entry into the Union of purebred

breeding animals, hybrid breeding pigs and the germinal products

thereof and amending Regulation (EU) No 652/2014, Council

Directives 89/608/EEC and 90/425/EEC and repealing certain acts in

the area of animal breeding ("Animal Breeding Regulation").

(3) These rules shall come into force within two (2) months

from their publication in the Gazette.

In these rules, unless the context otherwise requires

"Act" means the Veterinary Service Act;

"competent authority" means the Veterinary Services;

"Director" means the Director of Veterinary Services as

defined in the Act;

"Regulation (EU) 2016/1012" means Regulation (EU)

2016/1012 of the European Parliament and of the Council of 8th

June 2016 on zootechnical and genealogical conditions for the

breeding, trade in and entry into the Union of purebred breeding

animals, hybrid breeding pigs and the germinal products thereof

and amending Regulation (EU) No 652/2014, Council Directives

89/608/EEC and 90/425/EEC and repealing certain acts in the

area of animal breeding ("Animal Breeding Regulation").

(2) For the purposes of these rules, unless the context

otherwise requires, terms used in these rules which are not defined

herein shall have the same meaning as assigned to them in the Act and

Regulation (EU) 2016/1012.

The Veterinary Services as defined in the Act shall be the Competent

competent authority for the purposes of Regulation (EU) No 2016/ authority.

The model forms of zootechnical certificates for breeding Certificates and

Regulation (EU) 2016/1012 for the issuing of zootechnical certificates

by breed societies or breeding operations in accordance with the

requirement of Article 30(1) of the said Regulation, shall be those

found in Commission Implementing Regulation (EU) 2020/602 of 15

April 2020 amending Implementing Regulation (EU) 2017/717 as

regards the model forms of zootechnical certificates for breeding

animals and their germinal products.

(2) Without prejudice to the provisions of sub-rule (1), the

Court may also order any person who is found guilty of an offence in

accordance with these rules, to pay for the expenses incurred by the

competent authority and the Director as a result of the said offence, the

revocation of any permits or certification issued under these rules and

the confiscation, retention and disposal of the animals involved.

(2) Any act, decision or action taken before the coming into

force of these rules shall remain to be regulated by the provisions of

the regulations as in force prior to the coming into force of these rules.
