Keeping of Dogs (Amendment) Regulations, 2023

IN EXERCISE of the powers conferred by article 7(2) of the

Animal Welfare Act, the Minister responsible for veterinary services

has made the following regulations:-

(1) The title of these regulations is the Keeping of Dogs Citation and

(Amendment) Regulations, 2023 and these regulations shall be read commencement.

and construed as one with the Keeping of Dogs Regulations, S.L. 439.21.

(2) These regulations shall come into force within six (6) months

from their publication in the Gazette.

Regulation 2 of the principal regulations shall be Amends

added the following new definition

" "Director" means the Director for Animal

Welfare;";

(b)

the definition "Minister" shall be deleted; and

(c) immediately after the definition "tether" there shall be

added the following new sub-regulation

"(2) Unless the context otherwise requires, words

and phrases used in these regulations which are not defined

herein shall have the same meaning as assigned to them in

the Act.".

Regulation 8 of the principal regulations shall be Amends

renumbered as sub-regulation (1) and immediately after there shall be regulation

"(2) Where the Director has reasonable cause to believe

that an offence against these regulations has been committed and

that it would be appropriate to impose an administrative penalty

in accordance with article 47 of the Act, the Director shall

proceed in accordance with the provisions of the said article.".

Item 2 of the Schedule to the principal regulations shall be

substituted by the following new item

"2. The minimum space per dog must never be less than

the following

Provided that the minimum space for dogs in the table

as stipulated in this item, shall not apply to sanctuaries, pet shops

and, or boarding establishments for cats and dogs.

N is referring to the number of dogs in same enclosure

which shall not be more than ten (10) dogs.".
