REGULATOR FOR ENERGY AND WATER SERVICES ACT

Applicable Rate in lieu of the Proxy for the
Market Price Regulations, 2023
IN EXERCISE of the powers conferred by article 37 of the
Regulator for Energy and Water Services Act, the Minister responsible
for energy and water services, after consultation with the Regulator,
has made the following regulations:-
(1) The title of these regulations is the Applicable Rate in
lieu of the Proxy for the Market Price Regulations, 2023.
commencement.
(2) The scope of these regulations is to determine the rate to be
paid by the distribution system operator in lieu of the proxy for the
market price for the year 2023 in view of the international energy crisis
due to the Ukraine conflict.
(3) These regulations shall be deemed to have come into force
on 1st January 2023.
The definitions in the Regulator for Energy and Water
Services Act and in the Electricity Regulations shall apply.
The rate to be paid by the distribution system operator in
lieu of the proxy for the market price for the year 2023 shall be of eight
cents and eighty-five mils (€0.08,85) per kWh.
