Sale of Electricity generated from Cogeneration Units
(Amendment) Regulations, 2023
IN EXERCISE of the powers conferred by article 37 of the
Regulator for Energy and Water Services Act, the Minister responsible
for energy and water services after consultation with the Regulator, has
made the following regulations:-
(1) The title of these regulations is the Sale of Electricity
commencement.

and these regulations shall be read and construed as one with the Sale
of Electricity generated from Cogeneration Units Regulations,
hereinafter referred to as "the principal regulations".
(2) These regulations shall be deemed to have come into force
on 1st January 2023.
Regulation 2 of the principal regulations shall be amended
as follows
(a) the definition "annual", "annum" or "year" thereof
shall be substituted by the following new definition
" "annual", "annum" or "year" means the period of
time commencing on the 1st January and ending on the 31st
December of each year;"; and
(b) the definition "proxy for the market price" thereof
shall be substituted by the following new definition
" "proxy for the market price" shall have the same
meaning as assigned to it in the Electricity Regulations;".
Regulation 4 of the principal regulations shall be amended
as follows
(a)
sub-regulation (1) thereof shall be amended as
follows
(i) in paragraph (a) thereof, the words "for the
market price established under the Second Schedule" shall
be substituted by the words "for the market price
established under the Electricity Regulations"; and
(ii) in paragraph (b) thereof, the words "for the
market price established under the Second Schedule" shall
be substituted by the words "for the market price
established under the Electricity Regulations"; and
(b) in sub-regulation (4) thereof, the words "for the
market price established under the Second Schedule" shall be
substituted by the words "for the market price established under
the Electricity Regulations".
Sub-regulation (2) of regulation 5 of the principal Amends
regulations shall be substituted by the following new sub-regulation: regulation

"(2) The payment of the proxy for the market price
established under the Electricity Regulations shall be
subject to the approval of the cogeneration capacity as
required in these regulations.".
Regulation 6 of the principal regulations shall be amended Amends

(a) in sub-regulation (2) thereof, the words "for the
market price established under the Second Schedule" shall be
substituted by the words "for the market price established under
the Electricity Regulations"; and
(b) in the proviso to sub-regulation (2) thereof, the words

substituted by the words "in any year as established by the
Electricity Regulations".
In regulation 7 of the principal regulations, the words "for Amends
