Reception of Asylum Seekers (Amendment) Regulations, 2023

IN EXERCISE of the powers conferred by article 25 of the

International Protection Act, the Minister responsible for immigration

has made the following regulations:-

The title of these regulations is the Reception of Asylum

Seekers (Amendment) Regulations, 2023 and these regulations shall

be read and construed as one with the Reception of Asylum Seekers

Regulations, hereinafter referred to as "the principal regulations".

In paragraph (d) of sub-regulation (1) of regulation 6 of the

principal regulations, immediately after the words "when the applicant

is" there shall be added the word "detained".

In the proviso to sub-regulation (6) of regulation 6A of the

principal regulations, the words "transit zone." shall be substituted by

the words "transit zone:" and immediately thereafter there shall be

added the following new proviso

"Provided further that these temporary

derogations shall not apply in cases referred to in

regulation 5A of the Procedural Standards for Granting

and Withdrawing International Protection Regulations,

insofar as this regulation transposes Article 43 of

Directive 2013/32/EU of the European Parliament and of

the Council of 26 June 2013 on common procedures for

granting and withdrawing international protection.".
