Development Planning (Procedure for Applications and their

Determination) (Amendment), Regulations, 2023

IN EXERCISE of the powers conferred by Articles 84 and 85 of the

Development Planning Act, the Minister responsible for the Planning

Authority after consultation with the Planning Authority, has made the

following regulations:-

The title of these regulations is the Development Planning

(Procedure for Applications and their Determination) (Amendment)

Regulations, 2023, and these regulations shall be read and construed as

one with the Development Planning (Procedure for Applications and

their Determination) Regulations, hereinafter referred to as "the

principal regulations".

Regulation 20 of the principal regulations shall be

substituted by the following new regulation

Prior to the commencement of any works

"Commencement

notice.

relative to a valid permission, the perit shall submit the

relative commencement notice on behalf of the

applicant to the Executive Chairperson in the format

established by the Authority, at least five (5) days in

advance to the date of the commencement of works or

the utilisation of permit. The perit shall notify the

Executive Chairperson of the date of commencement of

works or of the utilisation of the permit.".
