Activities Requiring Permit by Local Councils (Amendment)

Regulations, 2023

IN EXERCISE of the powers conferred by article 16 of the

Trading Licences Act, the Minister responsible for local government,

after consultation with the Minister responsible for commerce, has

made the following regulations:-

The title of these regulations is the Activities Requiring

Permit by Local Councils (Amendment) Regulations, 2023 and these

regulations shall be read and construed as one with the Activities

requiring Permit by Local Councils Regulations, hereinafter referred

to as "the principal regulations".

Regulation 7 of the principal regulations shall be amended

as follows

(a) sub-regulation (1) thereof shall be substituted by the

following new sub-regulation

"(1) No person shall deposit or cause to be deposited

building material or other material in any street, without the

authorisation of the Local Council.";

(b) immediately after sub-regulation (1) thereof there

shall be added the following new sub-regulation

"(1a) No person shall place or cause to be placed a

scaffolding in any street, without the authorisation of the

Council.";

(c) in sub-regulation (2) thereof the words "or object",

wherever they occur, shall be substituted by the words "or

scaffolding"; and

(d) in sub-regulation (5) thereof the words "or object",

wherever they occur, shall be substituted by the words "or

scaffolding".

Regulation 13 of the principal regulations shall be amended Amends

regulation 13 of

as follows

(a) in sub-regulation (2) thereof the words "or any other

object" shall be substituted by the words "or scaffolding"; and

(b) in paragraph (b) of sub-regulation (10) thereof the

words "or object" shall be substituted by the words "or

scaffolding".

Schedule B of the principal regulations shall be amended as Amends

Schedule B of

the principal

regulations.

(a) item 3 thereof shall be substituted by the following

new item

"3(a) For the deposit of building material or other

material in any street for every metre square (m 2 ) or part

thereof for every day or part thereof ……...............….€2.33

(b) For the placing of a scaffolding in any street for

every metre square (m 2 ) or part thereof for every day or part

thereof …............................................................…..€2.33";

(b) in sub-item (ii) of item 7 thereof, the words "or other

objects" shall be substituted by the words "or scaffolding"; and

(c) the "Application for the Deposit of Building Material

or other Material or other Objects in any Street" shall be

substituted by the following new application

"LOCAL COUNCIL (Coat-of-Arms)

APPLICATION FOR THE DEPOSIT OF BUILDING MATERIAL

OR OTHER MATERIAL OR SCAFFOLDING IN ANY STREET
