DEVELOPMENT PLANNING ACT

Development Planning (Fees) (Amendment) Regulations, 2022

IN EXERCISE of the powers conferred by articles 81 and 85 of

the Development Planning Act, the Minister for the Environment,

Climate Change and Planning with the concurrence of the Minister for

Finance and Employment, and after consultation with the Planning

Authority, has made the following regulations:-

(1) The title of these regulations is the Development Citation and

Planning (Fees) (Amendment) Regulations, 2022 and these regulations scope.

shall be read and construed as one with the Development Planning S.L. 552.12.

(Fees) Regulations, hereinafter referred to as "the principal

regulations".

(2) The scope of these regulations is to continue helping and

incentivizing the applicants which are either the Malta Sports Council

or an entity registered with the Malta Sports Council.

Sub-regulation (1) of regulation 2 of the principal Amends

regulation 2 of

regulations, shall be amended by the following

the principal

regulations.

(a) in paragraph (g) of the definition "social/cultural/

sports/educational/forced relocation category" thereof, the words

"bars, restaurant);" shall be substituted by the words "bars,

restaurant); or";

(b) paragraphs (h) and (i) of the definition "social/

cultural/sports/educational/forced relocation category" thereof,

shall be substituted by the following new paragraph

"(h) development which is required to relocate by an

order of Government or a government agency or entity;";

and

(c) immediately after the definition "social/cultural/

sports/educational/forced relocation category" thereof, there

shall be added the following new definition

" "sports projects" means projects of sports facilities,

or ancillary structures excluding commercial ones;".

Schedule 1 to the principal regulations, shall be amended

by the following

(a) under the heading "Development" in Category A of

item 1 thereof, the words "Social/Cultural/Sports/Educational/

Forced Relocation" shall be substituted by the words "Social/

Cultural/Educational/Forced Relocation/Sports Projects"; and

(b) immediately following sub-item 27 of the proviso to

item 1 thereof, there shall be added the following new sub-item

"28.

Development applications including sport

projects submitted or validated after the 1st January 2021

and the applicants are either the Malta Sports Council, or a

body registered with the Malta Sports Council, are to be

exempt from the payment of Development Planning Fees

(DPF) and Environment Fees (EF).".
