Criminal Procedure (Regulation of Registries, Archives and

Functions of Director General (Courts) and Other Court

Executive Officers) (Amendment) Regulations, 2022

IN EXERCISE of the powers conferred by articles 697 and 701

of the Criminal Code, the Minister responsible for justice has made the

following regulations:-

The title of these regulations is the Criminal Procedure Citation.

(Regulation of Registries, Archives and Functions of Director General

(Courts) and Other Court Executive Officers) (Amendment)

Regulations, 2022 and these regulations shall be read and construed as

one with the Criminal Procedure (Regulation of Registries, Archives S.L. 9.09.

and Functions of Director General (Courts) and Other Court Executive

Officers) Regulations, hereinafter referred to as "the principal

regulations".

Sub-regulation (2) of regulation 3 of the principal Amends

in paragraph (e) thereof, the word "and" shall be

deleted;

(b) in paragraph (f) thereof, the words "and Tribunals,

Malta," shall be substituted by the words "and Tribunals, Malta;

(c) immediately after paragraph (f) thereof there shall be

added the following new paragraph

"(g) the inquiring magistrate in the record of any

inquiry relating to an in genere, an inquest or a repertus

conducted by a Magistrate of the Court of Magistrates

(Malta) or of the Court of Magistrates (Gozo) in

accordance with the provisions of Title II of Part II of Book

Second of the Criminal Code.".

Immediately after sub-regulation (3) of regulation 3A of Amends

the principal regulations there shall be added the following new sub- regulation

"(4) The magistrate conducting an inquiry relating to an in

genere, an inquest or a repertus shall, for the purposes of these

regulations, be considered as a court and the provisions of these

regulations shall apply to such magistrate in the same manner as

they apply to the Court of Magistrates (Malta) and to the Court

of Magistrates (Gozo) without prejudice to the provisions of the

Schedule.".
