MEDICAL AND KINDRED PROFESSIONS ORDINANCE

(CAP. 31)

Medical and Kindred Professions Ordinance (Amendment of

Third Schedule) (Amendment No. 2) Regulations, 2022

IN EXERCISE of the powers conferred by article 40A of the

Medical and Kindred Professions Ordinance, the Minister responsible

for public health, after consultation with the Council of Health, has

made the following regulations:-

(1) The title of these regulations is the Medical and

Kindred Professions Ordinance (Amendment of Third Schedule)

(Amendment No. 2) Regulations, 2022 and these regulations shall be

read and construed as one with the Third Schedule to the Medical and

Kindred Professions Ordinance, hereinafter referred to as "the Third

Schedule".

(2) These regulations transpose Commission Delegated

Directive (EU) 2022/1326 of 18 March 2022 amending the Annex to

Council Framework Decision 2004/757/JHA as regards the inclusion

of new psychoactive substances in the definition of "drug".

In Part B of the Third Schedule, immediately after the item

"EUTYLONE

1-(1,3-benzodioxol-5-yl)-2-

(ethylamino)butan-1-one"

there shall be added the following new items

"3-methylmethcathinone,

2-(methylamino)-1-(3-

methylphenyl)propan-1-one

3-MMC

3-chloromethcathinone, 3- 1-(3-chlorophenyl)-2-

CMC

(methylamino)propan-1-one".
