Safety of Toys (Amendment) Regulations, 2022

IN EXERCISE of the powers conferred by articles 38 and 39 of

the Product Safety Act, the Minister for Inclusion, Voluntary

Organisations and Consumer Rights, on the advice of the Director

General (Technical Regulations), has made the following regulations:-

(1) The title of these regulations is the Safety of Toys Citation, scope

(Amendment) Regulations, 2022 and these regulations shall be read and

commencement.

and construed as one with the Safety of Toys Regulations, hereinafter S.L. 427.40.

referred to as "the principal regulations".

(2)

The scope of these regulations is to transpose

(a) Commission Directive (EU) 2020/2088 of 11

December 2020 amending Annex II to Directive 2009/48/EC of

the European Parliament and of the Council as regards the

labelling of allergenic fragrances in toys;

(b) Commission Directive (EU) 2020/2089 of 11

December 2020 amending Annex II to Directive 2009/48/EC of

the European Parliament and of the Council as regards the

prohibition of allergenic fragrances in toys; and

(c) Commission Directive (EU) 2021/903 of 3 June 2021

amending Directive 2009/48/EC of the European Parliament and

of the Council as regards specific limit values for aniline in

certain toys.

These regulations shall come into force as follows

(a) regulations 2(a), (b), and (c) only insofar as the new

paragraphs (k) and (l) are concerned, and regulation 3 shall come

into force on 5th July 2022; and

(b) regulation 2(c) only insofar as the new paragraph (m)

is concerned, and regulation 4 shall come into force on 5th

December 2022.

Sub-regulation (2) of regulation 1 of the principal Amends

regulation 1 of

regulations shall be amended as follows

(a) in paragraph (i) thereof, the words "as regards

aluminium; and" shall be substituted by the words "as regards

aluminium;";

(b) in paragraph (j) thereof, the words "as regards

formaldehyde." shall be substituted by the words

"formaldehyde;"; and

(c) immediately after paragraph (j) thereof there shall be

added the following new paragraphs

"(k) Commission Directive (EU) 2020/2088 of 11

December 2020 amending Annex II to Directive 2009/48/

EC of the European Parliament and of the Council as

regards the labelling of allergenic fragrances in toys;

(l) Commission Directive (EU) 2020/2089 of 11

December 2020 amending Annex II to Directive 2009/48/

EC of the European Parliament and of the Council as

regards the prohibition of allergenic fragrances in toys;

and

(m) Commission Directive (EU) 2021/903 of 3

June 2021 amending Directive 2009/48/EC of the

European Parliament and of the Council as regards

specific limit values for aniline in certain toys.".

Item (13) of Part IV of Schedule I to the principal

regulations shall be amended as follows
