Public Service Commission Disciplinary

(Amendment) Regulations, 2022

IN EXERCISE of the powers conferred by article 121 of the

Constitution of Malta, the Public Service Commission has, with the

consent of the Prime Minister, made the following regulations

The title of these regulations is Public Service Commission

Disciplinary (Amendment) Regulations, 2022, and these regulations

shall be read and construed as one with the Public Service Commission

Disciplinary Regulations, hereinafter referred to as the "principal

regulations".

In regulation 2 of the principal regulations, immediately

after the definition "the 1999 Regulations" there shall be added the

following new definition

" "additional earnings" means income other than the basic

salary;".

In sub-regulation (4) of regulation 10 of the principal

regulations, immediately after the words "during the period of

summary suspension.", there shall be added the words "The officer

shall also be entitled to a refund of any other additional earnings that

would have been due during the period of the summary suspension.".

In sub-regulation (6) of regulation 12 of the principal

regulations, immediately after the words "for precautionary

purposes.", there shall be added the words "The officer shall also be

entitled to a pro-rata payment in lieu of any additional earnings

withheld over and above his salary, which payment shall be computed

on the mean average of the additional earnings of the previous three

(3) years prior to the precautionary suspension.".
