Protection of Workers from the Risks related to Exposure to

Carcinogens or Mutagens at Work (Amendment) Regulations, 2021

IN EXERCISE of the powers conferred by article 12 of the

Occupational Health and Safety Authority Act, the Deputy Prime

Minister and Minister for Health, after consultation with the

Occupational Health and Safety Authority, has made the following

regulations:-

The title of these regulations is the Protection of Workers

from the Risks related to Exposure to Carcinogens or Mutagens at

Work (Amendment) Regulations, 2021, and these regulations shall be

read and construed as one with the Protection of Workers from the

Risks related to Exposure to Carcinogens or Mutagens at Work

Regulations, hereinafter referred to as "the principal regulations".

Sub-regulation (6) of regulation 1 of the principal

regulation shall be substituted by the following

"(6) The scope of these regulations is to transpose

(a) Directive 2014/27/EU of the European

Parliament and of the Council of 26 February 2014

amending Council Directives 92/58/EEC, 92/85/EEC, 94/

33/EC, 98/24/EC and Directive 2004/37/EC of the

European Parliament and of the Council, in order to align

them to Regulation (EC) No 1272/2008 on classification,

labelling and packaging of substances and mixtures; and

(b) Directive 2017/2398 of the European

Parliament and of the Council of 12 December 2017

amending Council Directive 2004/37/EC on the protection

of workers from the risks related to exposure to

carcinogens or mutagens at work; and

(c) Directive 2019/130 of the European Parliament

and of the Council of 16 January 2019 amending Council

Directive 2004/37/EC on the protection of workers from

the risks related to exposure to carcinogens or mutagens at

work; and

(d) Directive 2019/983 of the European Parliament

and of the Council of 5 June 2019 amending Council

Directive 2004/37/EC on the protection of workers from

the risks related to exposure to carcinogens or mutagens at

work.".
