Civil Procedure (Regulation of Registries, Archives and Functions
of Director General (Courts) and other Court Executive Officers)
(Amendment) Regulations, 2021
IN EXERCISE of the powers conferred by article 1009A of the
Code of Organization and Civil Procedure, the Minister for Justice and
Governance has made the following regulations:-
(1) The title of these regulations is the Civil Procedure
commencement.
(Regulation of Registries, Archives and Functions of Director General
(Courts) and other Court Executive Officers) (Amendment)
Regulations, 2021 and these regulations shall be read and construed as
one with the Civil Procedure (Regulation of Registries, Archives and
Functions of Director General (Courts) and Other Court Executive
Officers) Regulations, hereinafter referred to as "the principal
regulations".
(2)
These regulations shall come into force on 14 December
2021.

Regulation 1 of the principal regulations shall be
substituted by the following new regulation
"1. The title of these regulations is the Civil Procedure
(Regulation of Registries, Archives and Functions of Director
Courts (Gozo) and other Court Executive Officers) Regulations".

Regulation 4 of the principal regulations shall be amended
as follows
(a) in sub-regulation (1) thereof, the words "Director
General (Courts)" shall be substituted by the words "Director of
Courts (Gozo)";
(b) in sub-regulation (2) thereof, the words "Director
General (Courts) and Tribunals" shall be substituted by the
words "Director of Courts and Tribunals (Gozo)";
(c) sub-regulation (3) thereof shall be substituted by the
following new sub-regulation
"(3) The
Director
General
(Courts)
shall
be
responsible for the management and administration of the
Gozo Courts, including the registries, archives and other
services. He shall head the Gozo Courts and all court
executive officers performing duties in the Gozo Courts
shall, in the execution of their duties, take instruction from,
and be answerable to, the Director of Courts (Gozo).";
(d) in sub-regulation (4) thereof, the words "Director
General (Courts)" shall be substituted by the words "Director of
Courts (Gozo)";
(e) sub-regulation (5) thereof shall be substituted by the
following new sub-regulation
"(5) Whenever a court or tribunal requires for the
execution of its lawful functions the use of any space as
aforesaid, it shall, through the deputy registrar assigned to
it or performing duties therewith, request the use of such
space to the Director of Courts (Gozo) or to such officer
whom the Director of Courts (Gozo) may delegate for the
purpose."; and
(f) in sub-regulation (7) thereof, the words "Director
General (Courts)" shall be substituted by the words "Director of
Courts (Gozo)".
