AUTHORITY FOR TRANSPORT IN MALTA ACT

Passenger Transport Services (Amendment No. 2)

Regulations, 2021

IN EXERCISE of the powers conferred by article 43 of the

Authority for Transport in Malta Act, the Minister for Transport,

Infrastructure and Capital Projects, after consultation with the

Authority for Transport in Malta, has made the following regulations:-

The title of these regulations is the Passenger Transport Citation.

Services (Amendment No. 2) Regulations, 2021 and these regulations

shall be read and construed as one with the Passenger Transport S.L. 499. 56.

Services Regulations, hereinafter referred to as "the principal

regulations".

Sub-regulation (4) of regulation 5 of the principal Amends

regulations shall be substituted by the following new sub-regulation: regulation

regulations.

"(4) Once issued, an operator’s licence shall remain valid

unless and until it is revoked, suspended or surrendered,

provided that the operator submits, within three (3) months

preceding the fifth anniversary from the issue of the said licence,

and every five (5) years thereafter, a declaration of compliance

with the requirements of regulation 6 supported by updated

documentation stipulated in regulation 7(1)(c) and (h), the

applicable fee stipulated in Part 1 of the Tenth Schedule, a police

conduct certificate and a signed declaration by virtue of which he

confirms that he still satisfies the condition of good conduct and

repute and that since the issuance of the last certificate referred

to in regulation 7(1)(a) he has not been found guilty of any

criminal offence in violation of the provisions of regulation 9.".

Sub-paragraph (iv) of paragraph (a) of sub-regulation (1) of Amends

regulation 9 of the principal regulations shall be substituted by the regulation

the principal

following new sub-paragraph

regulations.

"(iv) articles 4, 5, 6(a), 7, 8(b), 8(c), 8(e), 11, 13(2),

14(3), 15, 15A, 16, 17, 18, 22(1)(b), (c), (d), (e), (f),

22(1C), 22(1D)(a), 22(1E) and 22(3BA)(5) of the

Dangerous Drugs Ordinance;".

In regulation 20 of the principal regulations, the words "or

renewal" shall be deleted.

In sub-regulation (2) of regulation 22 of the principal

regulations, the words "not be transferable." shall be substituted by the

words "not be transferable:" and immediately thereafter there shall be

added the following new proviso

"Provided that within three months preceding the date of

expiry of the said driver’s permit and driver’s tag, and thereafter, the

holder thereof shall be obliged to submit an application for renewal

with the Authority in such manner and against such payment as may be

prescribed by the Authority together with

(a)

a police conduct certificate; and

(b) a signed declaration by virtue of which he confirms

that he still satisfies the condition of good conduct and repute

and that since the issuance of the last certificate referred to in

regulation 20(a) he has not been found guilty of any criminal

offence in violation of the provisions of regulation 9 and 19.".
