Regulations amending Various Regulations relating to Customs,

IN EXERCISE of the powers conferred by article 2 of the Fees

Ordinance and article 80 of the Customs Ordinance, the Minister for

Finance and Employment has made the following regulations:-

The title of these Regulations is the Regulations amending

Various Regulations relating to Customs, 2021

PART I

Amendments to the Regulations on Fees payable for the Issue of

Stamps or Bands under Part C of the Sixth Schedule to the Excise Duty

Act Regulations

This Part amends the Regulations on Fees payable for the

Issue of Stamps or Bands under Part C of the Sixth Schedule to the

Excise Duty Act Regulations and it shall be read and construed as one

with the Regulations on Fees payable for the Issue of Stamps or Bands

under Part C of the Sixth Schedule to the Excise Duty Act Regulations,

hereinafter referred to in this Part as "the principal regulations".

In sub-regulation (1) of regulation 1 of the principal

regulations, the word "stamps" shall be substituted by the words

"excise stamps".

Regulation 2 of the principal regulations shall be

substituted by the following new regulation

"2. The fee payable to the Commissioner for the

issue of excise stamps or bands under the provisions of

Part C of the Sixth Schedule to the Excise Duty Act shall

be, for every excise stamp or band

(a) €0.0049 in the case of Wet Glue

Banderol for cigarettes;

(b) €0.01545 in the case of roll-your-own

tobacco; and

(c) €0.05 in the case of water pipe tobacco

(also known as shisha tobacco).".

PART II

Amendments to the Customs Regulations

This Part amends the Customs Regulations and these Amends the

regulations shall be read and construed as one with the Customs Customs

Regulations, hereinafter referred to in this Part as "the principal S.L. 37. 05.

regulations".

Regulation 43 of the principal regulations shall be amended Amends

as follows

(a)

paragraph (a) thereof shall be deleted;

(b) paragraph (b) thereof shall be renumbered as

paragraph (a) and it shall be substituted by the following new

paragraph

"(a) whenever the attendance of a Customs official

is required during normal working hours and the official

uses his personal means of transport, there shall be made

a fee for the transport at the rate as established by virtue

of article 15 of the Public Administration Act

Provided that, no charges shall be demanded

in respect of all ferry fares between Malta and Gozo, and

of kilometres travelled in Gozo

Provided further that when attendance by a

Customs official is given outside normal working hours,

the charge for transport shall be calculated as specified in

paragraph (a) above with an additional charge three euro

and forty-nine cents (€3.49),which additional charge

shall be reduced to one euro and seventy-five cents

(€1.75) whenever attendance commences or ends during

the official’s on-duty period.".

Paragraph (c) of regulation 44 of the principal regulations regulation 44 of

shall be deleted.

Regulation 56 shall be substituted by the following new Substitutes

regulation

"56. (1) The forms in the Fourth Schedule shall

be deemed, by virtue of this regulation, to be the forms

referred to in the Customs Ordinance and in its subsidiary

legislation.

(2) Forms number 1(ii), 1(iii), 1 (iv), 1(v), 1(vi)

shall be filled in together with the form number 1(i), as

required by the Commissioner.".

The form 1a in the Fourth Schedule to the principal

regulations shall be substituted by the following new forms

(a) form entitled "Report by Master Form, Form 1(i)"

which form shall be associated with articles 6 and 52 of the

Customs Ordinance;

(b) form entitled "Crew List Form 1(ii)", which form

shall be associated with regulation 56.

(c) form entitled "Crew’s Effect Declaration Form 1(iii)",

which form shall be associated with regulation 56;

(d) form entitled "Ship’s Stores Form 1(iv)", which form

shall be associated with regulation 56;

(e) form entitled "Passenger List Form 1(v)", which form

shall be associated with regulation 56; and

(f) form entitled "Cargo Declaration Form 1(vi)", which

form shall be associated with regulation 56.
