Electronic Communications Networks and Services (General)

(Amendment No. 2) Regulations, 2021

IN EXERCISE of the powers conferred y articles 34 and 47 of

the Electronic Communications (Regulation) Act, the Minister for the

Economy and Industry, after consultation with the Malta

Communications Authority, has made the following regulations:-

The title of these regulations is the Electronic Citation.

Communications Networks and Services (General) (Amendment

No. 2) Regulations, 2021 and these regulations shall be read and S.L. 399. 28.

principal regulations".

Part B of the Eighth Schedule to the principal regulations Amends the

Eighth Schedule

shall be amended as follows

regulations.

(a) paragraph (c) thereof shall be substituted by the

following

"(c) for each unpaired 5 MHz channel in the 3400 –

3800 MHz band .....................................................€9,000";

(b) paragraph (f) thereof shall be substituted by the

following

"(f) for the rights of use in the 1900 – 2170 MHz

band consisting of a 5 MHz unpaired channel in the 1900 –

1920 MHz band and for 19.8 MHz of paired spectrum in

the 1920 – 1980 MHz and 2110 – 2170 MHz bands

(i) issued before 23 December 2019 for a

term of fifteen (15) years, either of the following fees

apply

(a) one-time upfront fee ........................

€5,823,433.50 or

(b) staggered annual payments as

defined in the rights of use, which in total

amount to .................................. €8,618,681.57;

(ii) for extensions to the rights of use referred

to in (i) above, per annum fee or part thereof
